    That is most likely why the info came out yesterday stating that there had been no deal offered to CK from UF.

    In a standard source selection process you would typically go with the fewest assumptions if all things are equal. I provides the lowest amount of risk. This, however, is not a typical source selection. There are no competing coaches, no other source of information. This is the Chip Dip extravaganza...just enjoy the ride. I swear this coaching search has become an episode of Ancient Aliens...if A then B, if B then C and if C, it is without a doubt, no other possibility, has to be Aliens.

    I am sorry but the more I think about it, the more skeptical I am about this supposed clause in CK's buyout deal with the 49ers that will reportedly result in him forfeiting a $5 million payment if he signs with another team before the end of this season.

    I feel like people are just eagerly latching onto this as the reason for why UF sent people to meet with CK in New Hampshire but came back empty handed. On its face it sounds like a good enough reason. Put off signing a deal for a couple weeks and pocket $5 million for it? Sure, who could blame CK for that?

    But what would be the reason for a relatively arbitrary provision like that in the buyout deal? Sign with UF on Sunday, after we've played our last game, and get $5 million from San Fran. But sign with UF on Friday, before the game, and forfeit the payment?

    Why? What purpose would that serve?

    If anything, you'd think an offsetting salary clause would say that if he takes another coaching job, then whatever he gets paid for that job will be subtracted from the payments San Fran owes. Why the arbitrary $5 million amount?

    Right, but you do not send all that brass just for courtship! It has to be way farther along in the process than just trying to convince him UF is the answer.

    It serves no purpose at that point, but if that’s the way the contract is written, that’s the way it is, unless both sides agree to amend/waive the clause. Offsetting language isn’t in all contracts, if a team (NFL) really wants a player or coach, the will usually cave on that part. That’s the one and only reason some early draft picks still take longer to get signed on the wage scale.

    Like a product warranty, for example. If you have something break on day 364 of a 1 year warranty, it’s covered. If the same thing breaks on day 366, tough nipples.

    Think of the clause as the "Will Muschamp" clause. SF didn't want CK to take a head coaching job immediately and basically be collecting two paychecks (buyout and paycheck from new position). SF says - your buy out means you stay unemployed if you want the money. I think it's certainly plausable that could be the reason and if CK is to become the next coach, maybe the trip with Strickland and Fuchs was a formality to get an official verbal agreement from CK.

    If she were on I-4 and there was an accident, I can see it. Rush hour is bad. That is why I live in Clermont - I don't have to deal with the "Ultimate project"

    Why would the contract have been written that way though? What would've been the rationale for that? If the best you can do is, "I don't know, that's just the way the contract was written," then you have to agree with me that it doesn't make much sense.

    Possible that there is a reason to wait based on a contractually mandated trigger, but that the specifics are not being reported accurately. Good news is it doesn't seem as if the UCLA rumor picked up much steam either, and there hasn't been a public 'no' from Kelly's camp or denial on UF's part.

    Looks like still sitting on a good offer on the table from UF that Kelly is considering. Fan impatience aside, not a bad place to be right now.

Also as others have mentioned, if there is some arbitrary clause about not signing something until the end of the season and he ultimately signs with Florida, surely the UF brass flying up to meet him could be grounds to challenge that legally speaking. Obviously there was a deal in place far enough along that the Gator big shots flew up to speak with him in person. I am no lawyer but it sure sounds like that wouldnt fly in court.

    I am certainly hoping that CK ultimately signs with UF but I think all of these conspiracy theories about a $5m buyout or setting up a publicity announcement are way off base. The simplest explanation is usually the correct one in that it appears that, for whatever reason, CK had a last minute change of heart and didnt sign the contract. He may end up with us in the end but it sure seems like the intent was to ink this thing on Sunday.
