    I don't think Barfield is right, because he doesn't understand how claims against state and local governments work in Florida. Just saying there is no specific law in Florida addressing privacy in Title IX claims is a big "so what"?

    First, Title IX IS a federal law. Whether any privacy requirements in Title IX trump state law I can't speak to, because that is a complicated subject. There are many instances in which the supremacy clause of the constitution and other federal laws allow the feds to trump state law.

    While Florida does have sunshine and open government laws, that is only part of the story. State and local governments really have no obligation to talk to the press unless they want to, or disclose certain information without a proper public records request. "Proper" being an important word.

    State and local governments get sued all the time. When claims and suits are filed against governments, they have the right to withhold certain information, such as the results of their investigations, their legal strategies, their settlement strategy, etc. Their governing bodies are also allowed to conduct duly noticed meetings with their attorneys out of the public eye. A court reporter will transcribe the meeting, but the transcript will not be released until after the case is resolved, if then, usually after receipt of a proper public records request. Otherwise, a governmental body would be seriously disadvantaged in the lawsuit by having to tell the other side everything.

    Given the timing of this claim, I doubt UF has received a proper public records request. Whether they have to disclose much of anything then depends on the request, and what Title IX mandates. I wouldn't be surprised if they disclose a redacted version of the complaint at some time, but not much else, unless they had decided to terminate someone, in which case they would say that in general terms.

    UF has a very competent legal department. They know what they are doing.

    The department of education was quoted in the ESPN article as saying any state laws would trump the title IX privacy rules. The spokesperson said that they aren't even allowed to comment or confirm a title IX complaint. So either UF legal department doesn't know this, they are using it as an excuse to hide, or the department of education doesn't know their own rules.

    There are NO Florida laws addressing privacy in Title IX cases as you have acknowledged. A non-existent Florida law could not possibly trump a Federal law that DOES exist under Title IX.

    This was sloppy reporting by ESPN-go figure- re: Barfield's statement. All he said was FLORIDA had no specific privacy law in Title IX cases. He never said that the Feds don't. ESPN didn't want to talk about that, because it didn't suit their narrative that we're covering up.

    UF is required to maintain privacy here, or it will get itself in hot water.

    Next game not until Mnday so Sunday seems most likely for any announcement. With the football team on ABC today, no need to make a statement that drives more negative comments on the broadcast.

    No possible way this complaint is formally presented to the University by victims counsel and is hidden from UF counsel. That is a bridge way too far.

    And happens all the time. Not to say Golden didn’t put himself in an untenable position, but I have seen it more than once. People can rationalize anything.
