    It isn’t either/or.

    He is personality liable, in the sense that he would be deemed “mentally competent” for his actions in any court of law. Being a cultist isn’t a legal out.

    That doesn’t mean he wasn’t in a cult or that he wasn’t influenced. Pretty much all the 1/6 short bussers would admit they were there at their orange gods invitation (some claiming in court they thought were following their commander in chief’s orders)

    People do things in an emotionally excited mob either a real or virtual mob they wouldn’t ordinarily do. He is responsible for his actions but they were highly influenced by the emotions and feedback of the mob that were providing positive reinforcement for his actions.
    Mob mentality = Cult mentality in my view.

    (The extraordinary request is an attempt by Smith to keep the election subversion trial – currently scheduled for early March – on track. Smith is asking the Supreme Court to take the rare step of skipping a federal appeals court and quickly decide a fundamental issue of the case against Trump.)

    I bet the Supreme Court answers Jack Smith's request with a line from a Ray Charles song.

    It actually isn’t that extraordinary anymore.

    The Supreme Court took up the affirmative action case before hearing the appeals court.

    Now there’s obviously at least 2-3 political hacks on the court that would obviously rather delay than rule this case on its merits, so I’m not predicting they will take it, but as this case is both inevitable to end up at the Supreme Court AND should be obvious the President doesn’t have “absolute immunity” it seems like the perfect decision for them to take up and rule quickly. I don’t think anyone expects even the political hacks to grant “absolute immunity”, but they could be interested in the delay tactics.
