That’s part of the issue. He used lower values on his tax reporting. That was evidence of the fraud. And, it doesn’t matter if he paid higher taxes if he obtained loans in reliance on false numbers.

The real problem in this country is H-U-N-T-E-R! They are all the same. The Biden Crime Family! You need to start following real news— not what the MSM tells you. All these judges are biased against Trump! No judge can be fair to him if they were appointed by Democrats or not appointed by Trump! So unfair! Rigged witch Hunt! o_O

This shows how truly stupid he in business. He takes waterfront Palm Beach property and restricts its highest and best uses.

The county and neighbors would likely agree to waive those covenants in exchange for agreements to single family homes, which would be quieter. The golf course certainly has a higher value if broken up. The problem is that based on the covenants, Trump limited the highest and best use and he can’t claim a valuation based on a use which is barred by covenants

. The civil system is not tue criminal system. There does not have to be a trial where the summary judgment standard is met. And since the Nixon-Reagan Supreme Court appointments, summary judgments are granted more frequently because those courts relaxed the federal standard, which is being increasingly adopted across the country. Summary judgment is proper if there are no genuine issue of material disputed facts and the moving party is entitled to judgment as a matter of law. The fact disputes have to be real. For example, if evidence shows that a property is valued based on a representation it is 30,000 square feet, but the property is only 10,000 square feet, that fact shows overvaluation as a matter of law. Whether the other elements of the statute are met depends on other evidence. I haven’t read the papers in this case, so I can’t comment on the merits of this order.

Parties are entitled to submit expert opinions in their summary judgment papers.

I see everything right about the Judge’s ruling. You’re focused on what Trump is telling you. Try for the moment to look at this neutrally, objectively. It is undisputed from the record that Trump carried two sets of books - one to give to lenders (which was fake) and one for himself ( which was real). Trump’s defense is that the accountants who compiled the numbers (basically put them in the balance sheets) put a disclaimer that said the ACCOUNTANTS are not warranting the truth of the information and that they relied in TRUMP. That disclaimer was not meant to say nobody could rely on the books, it meant that nobody could hold the INDEPENDENT ACCOUNTANT liable for the errors. Trump next relies on a disclaimer that essentially says the books are based on his good faith valuation of the current market value. But that defense was rejected because they were NOT based on his good faith valuation because that good faith valuation was set forth in the second set of (accurate) books, which information was uniquely in the possession of Trump. The issue of an “expert” is irrelevant to his fraud.

And on to this point. I live down here so I have a good common sense idea that, generally speaking, the values of beach front property are sky high. However, you completely discount the existence of the deed restrictions. Those restrictions significantly depress the value of the Property because of the limitations in the use of the property. Those restrictions, however, cannot be discounted as a matter of law. They exist. They are real. They cannot be wished into non-existence. And that is what the judge pointed out in his ruling.

And this is nit his first rodeo at defrauding the State of New York. Because of the uncharted repeated levels of wrongdoing, his unconscionable conduct is quite often lost in the volume.

Remember when he held a big charity dinner during his campaign, instead of going to a debate? He promised millions to dollars to veterans? And he raised a ton of money for the veterans?

And then didn’t give the money to the veterans?!?!?!

And as a result of his fraudulent actions, his Charity Foundation was fined millions and shut down in NY?!?

There’s a point in time when a fraudster is a fraudster and cannot continue to be allowed to operate businesses because he is a fraudster.

And it would be very difficult to find a property worth 20-50xx what the property assessor said it was (all of which they have claimed at different times). Small differences are inherent in the system. Differences like that are fraud. And he got caught.

Trump slanders the judge and AG outside the court moments before trial starts. Smart! I also notice that Melanie is nowhere to be seen but Hubba “Fun Bags” Habba is right by his side. Looks like he is about to trade wife #3 in for a newer model.

Smart for fun bags as she has no other prospects.

It’s described as a $250 million fraud case. Maybe he’s trying to prove it’s actually a $1 Billion fraud case, a case worthy of a true billionaire, by having the judge fine him $1 billion.

Trump is being tried by a single judge in the NY financial fraud case because his attorney neglected to request a jury trial. So today at lunch recess trump gave an impromptu press conference in which he said the judge:
    • Was corrupt
    • Should be disbarred
    • Could be charged criminally for what he’s doing
    • Was a trump-hater
Things not to say out loud in public, check, check, and check

LOL ... just heard about this but figured some of you beat me to it ... Trump has been slandering the judge for months, including this very morning ... walks into court ... learns that said judge will be deciding the case because his lawyers forgot to ask for a jury trial.

    For real?

How could the lawyers not realize this isn't a jury trial when jury selection is part of a jury trial... they had to know that didn't happen...
