The state of New York charged him with falsification of business records in the first degree 34 times. It is a felony. It was elevated due to the fact that he helped commit/conceal a federal crime by committing this crime. All of which is consistent with New York state law.

It only matters that Trump is guilty of the falsification of records and this crime can be linked to one of the other three crimes. Do this successfully, and the jury will likely convict. It is found in the Michael Cohen guilty plea. His plea was that he caused an unlawful corporate contribution and that he made an excessive campaign contribution. Trump falsified records to cover up his role in this crime.
