Discount Don trying to negotiate his surety bond with NY court. Is that possible?

    —————————————-
Breaking News: Donald Trump asked a New York appeals court to accept a $100 million bond as he sought a pause to the $454 million penalty in his civil fraud case, a clear sign that the former president lacks the money to cover the full amount.

Not sure if these links within links will help, but here are the Trump Memo and the Response.

    https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=oor8_PLUS_SyilUVorLgVywrDfQ==

    One excerpt from Trump's Memorandum:

An appeal bond would include the amount of the underlying judgment—here, more than $460 million—as well as costs and interest during the pendency of the appeal. Robert Aff. ¶ 46. To account for post-judgment interest and appeal cost, a surety will often set the bond amount at 120% of the judgment or more, i.e., more than $550 million. Id. ¶ 47. The exorbitant and punitive amount of the Judgment coupled with an unlawful and unconstitutional blanket prohibition on lending transactions would make it impossible to secure and post a complete bond. Appellants nonetheless plan to secure and post a bond in the amount of $100 million. Moreover, Appellants’ vast ownership interests in New York real estate (not to mention elsewhere) include 40 Wall Street,11 Trump Tower, Seven Springs, Trump National Golf Club Hudson Valley, Trump National Golf Club Westchester, and Trump Park Avenue. Thus, the ongoing oversight by the Monitor, which has and will continue to preclude any dissipation or transfer of assets, would alone be sufficient to adequately secure any judgment affirmed.
Appellants’ bond would simply serve as further security. Finally, Appellants discontinued the practice of preparing Statements of Financial Condition (“SFCs”) two years ago.

    James' Response:

    Excerpt from Response:

I write on behalf of plaintiff-respondent People of the State of New York, by
Letitia James, Attorney General of the State of New York (OAG), in opposition to the emergency application filed by defendants-appellants—various executives and entities of the Trump Organization—for an interim stay of the enforcement of a February 16, 2024 decision and order and the February 23, 2024 final judgment of Supreme Court, New York County (Engoron, J.) pending a full panel’s resolution of defendants’ motion for a stay pending appeal. Although OAG opposes an interim stay in full, this
letter addresses specific components of the court’s relief that would be particularly inappropriate to stay. OAG is prepared to address at argument both the components of relief discussed herein and the remaining components of relief, as well as the reasons why defendants are exceedingly unlikely to succeed on appeal. This Court should also expedite briefing on and the resolution of the underlying stay motion.

Bottom line: He doesn't have $500M in cash.

She addressed that a bit; I didn't read through all 35 pages of her response, but on page 30 of 35, there is a transcript of Trump testifying that he believed they had in excess of $400 Million in cash alone. Whatever the actual number might be, I see no upside for a judgment debtor to pay a higher bond amount than needed to effectuate a stay pending appeal. That doesn't mean his request is going to be granted of course.

I read there was an emergency hearing, but I didn't think we'd get a ruling today. I guess he's going to take his 8th Amendment argument to Fed court?

Especially considering that it's the norm although the story did apparently trigger a certain uninformed and ignorant segment of its readership as was intended by the publication.

Cannon rejects efforts to gain access to classified materials. She must be feeling the heat of a possible removal from the case

Judge Cannon rejects Trump’s evidence request in classified docs case (msn.com)

U.S. District Judge Aileen M. Cannon issued a nine-page order rejecting Trump’s arguments for his lawyers to see prosecutors’ filings under Section 4 of the Classified Information Procedures Act (CIPA), a law designed to shield national security secrets at issue in criminal trials. Cannon plans to hold a key hearing in the case Friday, where she will discuss the trial schedule, evidence disputes between prosecutors and defense lawyers, and a related disagreement over proposed redactions to court documents. The case is one of four criminal indictments that Trump is facing.
    ................................
In Wednesday’s ruling, Cannon noted the unusual facts of this particular case, in which Trump is accused of wrongfully retaining hundreds of classified documents at Mar-a-Lago, his home and private club in Florida, after leaving the White House — and then obstructing government efforts to retrieve them.

She suggested that the Justice Department’s special counsel, Jack Smith, may have overstated the CIPA law when he argued that the prosecutors’ filings cannot be shared with the defense, noting that the charges against Trump do not include giving the restricted information to others.

“The Court cannot speak with such confidence in this first-ever criminal prosecution of a former United States President — once the country’s chief classification authority over many of the documents the Special Counsel now seeks to withhold from him (and his cleared counsel) — in a case without charges of transmission or delivery of national defense information,” Cannon wrote.

Ha ha ha ha ha. Scotland joins the party fining trump $267m. The Scot’s being fine people absolutely freaking loathe trump. They especially hate his golf course. Word is they are angling for it because it’s evident he’s broke and the rubes can’t give that kind of coin. Note to rubes forget what I said you absolutely can but you need to step up your game.

Donald Trump has been found to have fraudulently boosted the value of Scottish homes by up to £200 million. A judge's civil fraud case revealed that the Trump Organization had valued a 2,500-home development at £83,164, significantly lower than the actual value[1]. The fraudulent methods used by the Trump Organization included inflating property values and using false numbers in property valuations[2][3]. As a result of this fraudulent activity, Donald Trump has been ordered to pay over $350 million in damages in a civil fraud case, with potential interest charges adding another $100 million[4]. Despite denying committing fraud, Mr. Trump is facing significant financial consequences and legal restrictions as a result of these findings[5].

when 90% worth billions isn't enough. Schmuck tried to screw the guys who set it up for him and only kept 10% for themselves.

Melania better get her prenup amount secured or bonded, he isn't going to have anything left after he has to unload properties in a firesale to raise funds and the russians aren't able to buy them from him

'No legitimate business purpose': Trump sued by Truth Social business partners (msn.com)

Initially, Trump's stake was 78 million shares, valued at roughly $3.5 billion. UAV's stake in the company amounted to seven million shares valued at approximately $339 million. However, the lawsuit alleges Trump then engaged in a "dilution scheme" to increase the number of total shares to one billion, which they said had "no legitimate business purpose." UAV accused Trump of possibly scheming to distribute the additional shares among himself and his family, while significantly decreasing their stake in the company to less than 1%.

"[UAV was] promised 8.6 percent of this company and sadly its business partners are baselessly trying to renege," Litinsky and Moss' attorney, Christopher J. Clark — who has previously represented Hunter Biden, Elon Musk and Mark Cuban — told the Post.

"They feel like: We made Truth Social for you. You get 90 percent. But some people just aren’t happy with 90 percent."

UAV has since threatened to block TMTG's merger with the SPAC, which would significantly delay its plans to go public. The SPAC stated in a filing with the Securities and Exchange Commission that the latest developments could "significantly impact" the proposed merger and "negatively impact investor confidence and market perception."

Politics aside I really don't understand why anyone would trust or want to do business with Trump. His track record of screwing over everyone is phenomenal. Lawyers. Wives. Contractors. Business Partners. Truly phenomenal.

“Doing business” in the loosest possible terms. Trump attracts grifters like dog poop attracts flies. It’s not like anyone turned down a Silicon Valley job to go work there. The CEO is Devin Nunes FFS. When you understand that it’s a grifting operation, and there is no eye on building a sustainable going concern, it makes perfect sense that the only objective was to screw each other over # shares. The only objective is to raise money and get out.

To anyone that supports this man I ask
    • Would you go into a business partnership with trump?
    • Loan him money?
    • Work for him on contract?
    • Hire him into your organization?
    • Leave him alone in a room with a young attractive female family member?
