The “errors” that will he appealed are: (a) the first case was decided in error and thus the second case must be in error (remember first case is in appeal), (b) the court’s refusal to allow evidence in defense in the second case, and the one with the best chance of success IMO (c) the punitive damages award (I don’t know NY’s laws in punitive damages but many states limit the amount, disallow in full or in part punitive damages already assessed, and/or will reduce punitive damages when the penalty is disproportionate to the action, amongst others. This is an award that was high. Appeals are always an uphill battle —it’s the definition of an appeal, but I would not say he has no chance, and I definitely wouldn’t say he has no chance based on the points raised in that tweet.
