Some Republicans are considering impeaching Janet Protasiewicz, here's how we got here

    MADISON, Wis. (AP) — Even before the newly elected justice who gave liberals a one-seat majority on the Wisconsin Supreme Court has heard a case, Republican lawmakers are talking about taking the unprecedented step of impeaching and removing her from office.

    And they have the votes to do it.

    Republicans worry that the legislative districts they drew 12 years ago, which are widely viewed as among the most gerrymandered in the country, will be undone in one of the court’s first actions under liberal control. It’s a legitimate concern, as Democratic-friendly groups brought two lawsuits in the first week of newly elected Justice Janet Protasiewicz’s term asking the new liberal-controlled court to toss the maps.

    Looks like a redistricting case will be coming up and the GOP needs to do anything it can to remain in power. Unfortunately they have the votes in the house and senate to do it

    So to hell with what the voters of Wisconsin want, impeach her ass and get someone the gop likes instead. Sounds like representative government to me. :rolleyes:

    A couple of years ago, Wisconsin’s gerrymandered map was part of an FRQ on the AP US Government exam. Kids had to explain how 50% of the voters got 75% of the seats. If a 16/17 year old can figure it out …

    A couple interesting issues here:
    1. Tony Evers, the Democratic Governor, would appoint the replacement. So the Republicans would likely only succeed in enraging the voters.
    2. Protasiewicz could sue in state court to invalidate the impeachment. Wisconsin's constitution has both impeachment and something called removal by address. Removal by address explicitly applies to state supreme court justices. Whether impeachment does is an open question. Removal by address requires two-thirds majority in both chambers. The GOP only has a two-thirds majority in the Senate. So they can't remove Protasiewicz by address.

    If I'm Protasiewicz's lawyer, I file a case in Madison or Milwaukee arguing that the Wisconsin Constitution requires removal by address for state supreme court justices because it is the more specific provision. I file in one of those two venues because both are dominated judges who align with the Democratic Party. Since the Wisconsin Supreme Court will be 3-3, that means if they deadlock, the court of appeals's opinion controls. Basically, that means liberal judges will get to decide the issue.

    It's getting even slimier. Republicans are now considering impeaching her in their House, but not having a trial in their Senate. Apparently under state law, she would be suspended if they voted to impeach. They don't think they have the votes in the Senate to convict, so this way they would effectively neutralize her and deny the citizens the liberal leaning court they overwhelmingly voted for.
