The crux of EMTALA is that an ER must evaluate and stabilize any emergency medical condition to the best ability of the facility if they can’t do so they must stabilize and transfer to a facility who can to the best of their ability. An ectopic pregnancy would typically fall into this category however an elective(although perhaps needed) D&C may not it would really depend on the details(which is where this sad situation started).
There's currently a case under consideration by the Supreme Court, Idaho v. United States, in which the Court will, in effect, decide whether a state law banning virtually all abortions takes precedence over EMTALA. The Biden Administration is taking the position that EMTALA should take precedence, the State of Idaho is taking the opposite position.
For those who believe these laws allow doctors to do what is medically necessary for their patients, the lawyers for Idaho explicitly said that they could not say that this was 100% true.
I would add that not only did the State's ban not protect the fetus who had virtually not possibility of survival it resulted in damage to the woman's reproductive system to the point in which she may have been rendered infertile and incapable of having any children in the future. Maybe it's just me but I do not consider the state's poorly drafted law to be "pro-life".
If you look up thread I discussed some of the specifics based on the articles, the issue that caused her to lose an ovary and tube was due to an incomplete D&C. That had nothing to do with the law in place. It was exacerbated by what appears to be incompetence and lack of proper follow-up care by her doctor when she presented with retained products of conception and fever. It seems to have little to do with the law.
If she had been able to have the procedure with her doctor instead of traveling all over to find anyone willing to do the procedure, could the results have been different?
It is a risk with D&C, the suspect thing based on the article is the doctor (unclear if it was a ON/GYN) seemingly missed symptoms which put retained POC at the top of the differential. It was noted she had fever which gives one a high index of suspicion. Based on the info in the article the liability is with the doctor who saw her then and seemingly missed a big one. Having to travel all over has little to do with the initial procedure. It seems like she called all over until she found someone to do it. As a side note often fetal demise are treated with watchful waiting letting nature take its course. Doing the procedure introduces more risk so it’s not always done unless some has an incomplete abortion(natures way). Most D&C are done electively as an outpatient. There are few instances where one is done urgently or emergently. This is something I dealt with in the ER two decades. Foe the record I’m not in favor of these strict laws regarding abortion, but it appears they are using an unfortunate incident to blame a law where it appears the issue was really with questionable care from her doctor. This is based only on the details in the story for the record.

I thought I knew the far right Catholic colleges and that language seemed a little out there, even for them. Not even sure you would hear that at Ave Maria or Steubenville.
