Racist thugs see opportunity to beat black man get rude surprise

Watching the various videos, I started wondering about something. In the past, there’s been discussions on too hot about the legal level of response to violence. I recall an illustration like if someone punches you in the face and turns and walks away, you cannot take a baseball bat to the back of their head.

In a situation like the dock, what is the duty to retreat? I’m thinking of a particular woman sitting on the dock and a man standing over her, pummeling her in the head. Is that justified because she earlier had taken part in someway in the tussle? Did he have a duty to not hit her when she was sitting on the dock?

Another instance, the guy with the chair who had whacked a guy who had been throwing punches, left him and went to a woman sitting on the dock, and whacked her over the head with the chair. Is that legal, considering she had also been taking part in the tussle earlier? Or did he have an obligation to walk away once the offender had stopped fighting?

This is in no way criticizing those who came to the defense of the deckhand. He was being attacked, and they came to ward off the attackers. That was the right thing to do and I see no problem with that. How much, however, in a situation like that, can they continue to punch people who have stopped fighting?

I don’t have a preconceived answer. I’m putting it out for discussion.

Alabama is a SYG state..no duty to retreat before using deadly force under the appropriate circumstances.

NOTE: Most of the following will be applying Florida law which I assume to be generally similar.

The guy that hit the woman over the head with the chair is guilty of at least battery or possibly aggravated battery, if the chair could be considered a deadly weapon. It does not matter what she did earlier, she was totally non-aggressive at the time.

Self-defense means using force to PREVENT an attack, not inflicting revenge for one that occurred earlier.

If you are in a bar and I try to punch you, you are authorized to stop me using reasonable force. If I punch you and then try to punch you a second time, same thing. If I punch you, immediately drop my hands and back away from you to the point I no longer pose a threat to hit you again, you are likely NOT authorized to punch me. I get it that's easy to say as I'm typing and not getting hit, I'm just indicating what the law is. If you did punch me in the third scenario, the cops would likely be sympathetic to your cause, even if you did technically commit a crime.

 

Hard to say. I think I’m of the opinion that anyone who instigated violence or participated in violence who was not being directly attacked or who was not defending a friend or family member who was being directly attacked should be charged. Now good luck figuring out who in that video this applies to and who it doesn’t. But I don’t like the idea of forgiving everyone who participated in a brawl who didn’t start it. Sets a terrible precedent.

 

I just sold my offshore boat but I still have five smaller boats and a canoe. Where does that put me on the boat ass spectrum? Be careful or you might never get invited for a cruise in a 1959 or ‘60 classic with fins.

Outside of the people who were genuinely trying to stop the attack on the boat crewmember, it was all likely a violation of the law. But you have to keep in mind that just because somebody technically violated the law doesn't mean you want to try and prosecute them for it. Montgomery is 60% Black. You've gotta convince a jury to convict.

That was the one good thing about this brawl taking place in the marina, most gun owners aren't going to carry their firearms with them on a boat. Now had the brawl spilled over into the parking lot, you may have seen some of the combatants going to their vehicles to "pop the trunk" and then it could've gotten deadly.

 

Are you saying that Montgomery juries are base verdicts on race? If so does this make them racist?

 

Floribama man, I'm saying that when they see white racists jump a Black crewmember trying to do his job, they're unlikely to convict that Black crewmember's colleagues for whooping those racists' asses. I know I wouldn't vote to convict them.

 

I wouldn't either. But I still think they should be charged. Let the jury decide.
