Potential criminal activity occurs where we say it does, says Florida

    Two different stories on the front page, both involving legal challenges to DeSantis Administration measures based in large part on geographical jurisdiction.

    First, Florida voters barred Casino Gambling in the state Constitution, which would include sports betting. But this group has never deemed themselves constrained by law or democracy. So the pact with the Seminoles to call in bets.

    The battle centers on part of a 2021 deal between the state and the tribe that allowed gamblers to place mobile sports wagers anywhere in the state, with bets handled by computer servers on tribal property. The deal said bets “using a mobile app or other electronic device, shall be deemed to be exclusively conducted by the tribe.”

    I realize sports gambling already occurs remotely and this may not be that great a change. My point is more the transparent attempts to avoid legal restrictions.

    Second, DeSantis statewide prosecution of voting, and his desire to intimidate voters and again prove his racism. But a statewide task force only has jurisdiction over multi-county “crimes”, so DeSantis wants to make sure the crime of voting is not viewed to have occurred only in one county. but when you vote in Dade County, the vote is ultimately tallied in Leon, making it a statewide crime spree. Plus, ignorant Right Wingers have become persuaded that any plebiscite they don’t win is illegal, and we have to cater to their vicious ignorant bigotry


    Even before the amendment change, though, the state said in its briefs, they had authority because Miller’s alleged crime occurred in Miami-Dade County, where he registered and voted, and in Leon County, where his application and vote was sent.

    Statewide prosecutors also argued in their initial brief that the alleged crime affected the entire state of Florida by creating mistrust in election integrity and by affecting an election’s outcome, which “may well decide close elections that determine how Florida is governed.”

    Legally, this may arise in the future when women need to be channeled into being Moms for Liberty and don’t have the right to travel across state lines to procure an abortion. We’ll see
