    cooperation demonstrates a lack of intent and has always been a factor in prosecuting decisions. I mean, you seem like maybe you just fell off the turnip truck on this topic, but that’s the way it’s always been.

    Well there was certainly intent or the documents wouldn't be there right? So I just fell off or I have always been off? Which is it? Perhaps you should go back to sleep and let the grown ups talk it out.

    Yeah, cooperation makes it ok. Hiding documents and lying to the FBI about it makes it not ok.

    Wrong. Do Pubs simply not care about laws and the Judiciary to note differences between Federal and State prosecutions?

    yeah, I take that back. Seems like you never even made it to the turnip truck. You’re like a walking, posting demonstration of the Dunning-Kruger effect. I’m sure there are some things you do understand, but clearly criminal law ain’t one of them.

    It shows that the retention of the classified documents was likely inadvertent. And it shows that you are trying to make it right. Neither of those things were the case with Trump. Also, the amount of documents Trump was hoarding was far greater than what Biden and Pence had (and voluntarily turned over). All of that matters. Bottom line is Trump would not have been indicted if he'd simply cooperated like Biden and Pence did.

    Trump was King of the Executive Branch. All power resided with him. He could declassify any document he wanted. Documents Trump took to Mar-a-Lago were automatically declassified.

    Biden is the guy who stole classified documents. He had no authority to declassify them unless he was the one who classified them in the first place, as I understand it.

    Biden broke the law, Trump did not.

    ~98% of the time documents are classified to cover somebody's rear end.

    The reason Mar-a-Lago was raided is that the FBI wanted the Crossfire Hurricane documents Trump possessed that documented FBI criminality.

    I'm sorry, if you are carrying around classified docs to places that you shold not then you are risking exposing the documents. Admitting it after the fact does not change that fact.

    Just a couple of problems. Both the president and the vice president have the authority to declassify documents. In order to do so they must follow a formal procedure. There is absolutely no evidence that Trump ever followed that procedure prior to leaving office (same for Biden although he never claimed that he declassified the documents).
    Fact check: Biden had the authority to declassify as vice president
    Former official told investigators Trump had 'no standing declassification order' regarding documents, filing says
    Even conceding that there is a problem with over-classification of documents, there is still evidence that Trump mishandled highly classified documents after leaving office.

    No, most documents are classified because the information is classified. Let’s not pretend the classified documents did not contain classified information and was just marked classified for convenience

    The US creates millions of classified documents a year. There are dozens, if not hundreds of cases a year of people having classified docs when and where they are not supposed to have them. The DOJ is consistent on whom they charge and whom they do not in these cases.

    In general, return 100% of the docs, and cooperate fully allowing the Feds to search for me docs, and as long as no damage was done, there will be no charges. Both Pence and Biden cases fit here. Trump? Not so much.

    Trump didn't return everything. He lied on n affidavit about doing so. Trump also never fully cooperated and it requires a search warrant for the Feds to get access.

    It's also a lie a President can magically declassify by thinking so. Declassified docs go through a process and carry obvious declassified markings. Without those markings, there is no way to distinguish between real classified docs and Trump magically declassified docs. And legally speaking, all docs with classified markings are treated as classified.

    Again, Pence and Biden weren't charged because they cooperated. Trump didn't.

    It's a case by case basis. But full cooperation, no damage done, chances are there will be no charges. Or a hand slap agreement plea deal. One issue with classified document cases is a jury would need clearance to see the docs. The DOJ would prefer to avoid this if at all possible.

    I love how the Liberals that applauded all the BS that the Puppet Biden did to his political opponents now seem to think they can get away with it by running what will be interference in getting the Trump cabinet confirmed.
