Jalen Kitna breaks silence after being vindicated...

    I'm not defending "ESPN" ... there is really no need to defend ESPN ... they were reporting on what the police said -- and probably quoting the police accurately since the same information was also reported by multiple other sources.

    Why was he allowed to plead no contest to a lesser charge? I don't know. Maybe because he had a clean criminal record and his defense was apparently preparing to make the case that is came from a "legal" porn site and Kitna had no way of knowing it was illegal. Note, even his letter, he doesn't claim it was legal images, he says the legal status was undeterminable, and therefore not illegal. It just takes one juror to believe that.

    Question is, why are you defending the police so much? If you truly believe this is a nothing burger -- that he had one photo of partially clothed adult woman that he got from a legal porn site -- then you should be super pissed at the cops for claiming he had images of a prepubescent girls being raped by adult males on his phone ... then the cops feeding those reports to ESPN and dozens of other news agencies.

    I'm glad that he was cleared, but for me, it still has some stench to it. There is a huge difference between what was described as "prepubesent" and "potentially underaged". Female puberty typically begins at 8-13 and you will never convince me that a 12-13 year old will ever be confused with a 16-17 year old. Mistaking a 16 year old for a 20 year old is a valid arguement, but not 13 for 16.

    Family had great lawyers.

    My son is starting college (FL Poly) soon and I used Kitna as an example to never share photos with anyone as you can never be sure of their age.

    I disagree. Your assumption ignores the legal standard that must be met before one can prevail on a false arrest claim. It's not that easy, as simply establishing that you were innocent of the charge is not sufficient to prevail. Rather, the law protects police officers as long as they had probable cause for the arrest. Probable cause can be established simply by showing that based on the information presented at the time, a reasonable person would believe that a crime had been committed. In federal court, the "reasonableness" is viewed from the standpoint of the police; in state court, the police must establish probably cause, or the existence of an arrest warrant.

    You can't just establish that you were innocent of the crime; you essentially have to establish that no reasonable cop under those circumstances would have made that arrest.

    All this speculating about what went on behind the scenes to get this outcome for Kitna is interesting, but misses what really happened here. The state arrested Kitna based on some information, but without doing a thorough investigation. Once Kitna's lawyers started probing the state's case, and the prosecutors got more involved, the case fell apart, and the prosecutors realized they could not prove the charges. At that point, they scrambled to get Kitna to plead to anything--even if it was a minor misdemeanor- in order to save face. That is obvious, as the misdemeanor Kitna plead to--disorderly conduct--bore no relation to the original charge. Had the state been able to prove the original charge-which is a very serious crime- they would NEVER have agreed to the plea deal struck. And the supposition that Kitna got off because his dad played in the NFL is absurd, given the gravity of the original charges.

    The only logical conclusion one can draw from this is that Kitna was innocent or that the State couldn't prove the charge. Given that the charge was based on electronic transmissions which the State had in its possession, the fact that they couldn't prove a crime is essentially an acknowledgment of innocence.

    College football quarterback takes plea deal in child porn case that doesn't require him to register as sex offender

    Forwarded images, another Discord user found offensive, someone reported him, … Discord account closed for policy violation. Arrested. In addition to the two Discord images that were reported by another user, they found 3 more images of naked girls where age was difficult to determine. Dropped felony charges and plead guilty to two other charges in plea deal. Now on probation. Best outcome was that he did not have to register as a sex offender. Was fortunate to have family with money that could have take case to trial, as outcome could have otherwise been different. Agree it was the right outcome but reading the above link you know this was not a surprise to him.

    Just because a person is arrested doesn’t make or prove they are guilty.
    Another example of why we all should never judge a situation without facts, not allegations. Happens to all of us at some point.

    Sometimes guilty people get their charges reduced, too ... IIRC, the reason the charges were reduced is because the girl's face was cropped out of the photo, so the police couldn't prove her ID ... but everyone who saw the photos thought it was child porn ...

    GPD can’t even manage game day traffic anymore. They’re awful Nd they and whatever prosecutor they took this to are the issue here. We have small people running both organizations that want to make the news.

    I think we can safely consider this case Duke LaCrosse lite. At least in the Duke case that POS Nifong was brought down.

    This is a major issue when it comes to Gator football. This, along with the 2017 suspension of nine players is ludicrous. Both were way overblown by LE knowing full well the media would run with worst case scenario as they reliably do.

    If you can’t manage game day traffic then please don’t handle anything more serious that requires logic, reasoning, and sound judgement.

    Good for Kitna. I hope he makes the most of it.

    And props to UAB.

    The kid obviously just did something careless and paid way too high of a price for it.

    Even if he did something more serious than the bullshit they pinned on him; There are no sinners without a future or saints without a past.

    Well reasoned ... since there are major traffic jams in Gainesvillle 6 times a year when 90,000 people try to leave the stadium at the same time ... therefore, GPD shouldn't investigate crimes ...

    He played that Sunday game against whatever direction Washington quite a bit. And seemed ready when AR went out for a part of a drive against fsu.
    At least I think I’m thinking of the same backup.

    Well reasoned, from someone whose life is in front of their device and doesn’t go to games in Gainesville or in different places to see how the people who do it well do it.

    Other than the Utah game last year 90,000 haven’t left at the same time since 06. It’s also not about people, it’s about cars. I guess you assume 90,000 people come to games alone.

    Another Keyboard Cowboy who knows it all.
