    I've seen it suggested that the Judge may throw out the case since Bragg included evidence and testimony that could fall under official duties of the POTUS, thus making the ineligible to be entered into evidence. If that is the case, the Judge might have to declare a mistrial and throw the conviction out.

    It would depend on whether the judge determines if that evidence was so prejudicial as to affect the outcome of the case. If he determines that it wasn't it's inclusion be considered harmless error.

    If it was not important, why include it when you know the SCOTUS is going to rule on that issue ahead of time? Bragg and the Judge both knew this but still allowed two witnesses to testify about it. Just seems like they were either over aggressive or sloppy.

    This may be OBE shortly. Halperin thinks a deal is going to get done where NY Governor Hockel will pardon Trump in exchange for Hunter getting pardoned and the Trump DoJ not going after Bragg/Biden/etc, and everyone calls a halt to the LawFare of the last couple years. Halperin has been right on a lot of things this year so I am paying attention to what he is saying.

    At this point even if the case isn't dropped, the worst that he could happen to Trump would be a suspended sentence and maybe a symbolic token fine. He definitely wouldn't be incarcerated and probably wouldn't even be sentenced and whether you're willing to admit it or not you're implicitly advocating that a former one-term president who decides to run for office again should be immune from prosecution. While I think that the NY case was the weakest case against Trump, the case against him for mishandling the classified documents was much stronger. I would add that obviously it will disappear along with DC election interference case within the next couple of weeks.

    Actually, I am not. Bragg did not have to include those two witnesses' testimonies in the trial. If he does not do that, then there is not reason to appeal on immunity grounds and the judge could have actually imposed a sentence on Trump prior to election day. Take it up with Bragg and the Judge for including that info when they did not have to.

    I agree that the other cases were stronger and had a much better chance of a conviction actually standing.
