The DoJ has to since a sitting POTUS cannot be prosecuted by the federal government. The question is if they are ending the case or preparing to preserve them for after Trump leaves office.

Bill Barr was trying to send a signal to DOJ staff back in April, by endorsing Trump. Jack Smith and Leticia James have the most exposure, I think. Smith for appealing something the SCOTUS clearly didn't want to be a case. James is a moron for doubling down the day after the election.
Those of us paying attention know that Smith presented sufficient evidence to convince federal grand juries to indict Donald Trump for several, serious crimes against our nation. The rest of you can bury your heads in the sand and pretend this didn't happen.
