    If she's presenting as a woman and has woman parts, I'm not sure what the objection is.

    You can also purchase a cake somewhere else. How did that go over?
    You can also drink from a different water fountain.
    You can choose to not go to the bathroom either because trans males allowed in female bathroom.
    You can choose to not use locker room with intact trans male.
    You keep saying this happens so rarely, why not try to eliminate it because next when you are not paying attention it might be your daughter in that locker room with the intact male.

    Even with private schools, it appears there have been some relatively recent developments, and it's not entirely settled? I also thought about this briefly in the light of people saying Harvard gets a lot of breaks or benefits which open it up to Congressional scrutiny. I have not vetted this page BTW.

    Recent Court Opinions Suggest Independent Schools May Be Subject to Title IX | McGuireWoods

    Historically, most independent schools have not been subject to Title IX of the Education Amendments Act of 1972 because they do not accept federal funds. As a result, many independent schools carefully evaluate whether to accept certain funds so they can control whether they are subject to Title IX.

    In the past two years, some independent schools have cautiously accepted federal financial assistance under the Paycheck Protection Program (PPP), with an understanding that, based on guidance from the Department of Education, doing so would require compliance with Title IX only until the PPP loan was fully forgiven or repaid. However, in decisions that may have dramatic effects on independent schools throughout the United States, two federal courts recently expanded Title IX coverage, ruling that independent schools may be subject to Title IX based on their tax-exemption status alone.

    Title IX applies to any recipient of federal financial assistance. 20 U.S.C. § 1681(a). Therefore, a Title IX claim against an educational institution requires a claimant to first establish that the educational institution receives federal funds. Whether an institution accepts “federal financial assistance” is defined by the regulations governing Title IX. For example, an independent school may be subject to Title IX if it receives a federal grant or loan of funds made available for the acquisition or construction of a building or facility, or for scholarships to students.

    For decades, the U.S. Department of Education and courts have not interpreted an educational institution’s 501(c)(3) tax-exempt status as “receiving federal assistance” under Title IX. However, in separate cases decided in late July 2022, two federal courts found independent schools were subject to Title IX based on their 501(c)(3) status. These rulings may have implications beyond education, as any tax-exempt organization may be subject to Title IX by virtue of the tax status.

    Actually, I leaned toward the baker in the cake issue.
    The drinking fountain isn't remotely similar.
    I'm certainly not in favor of 'intact males' in the girls locker room. But that's to be decided by whoever is running the gym.
    I spent a lot of years coaching girls' soccer. I've been out of it for a while so I don't know what the local leagues are doing. But if a league allowed boys to compete against girls, most of the girls would find another league.
    BTW, one daughter did spend a season on a mostly boys team. By choice.

    But let me go back to my earlier example: Do you think the state government should decide who is allowed to compete in the Jacksonville Cycling Club's races?

    Using your logic, I'm going to open a bar and allow any age girls in that wants to come in. I'm running it so it should be my choice and if you don't want to come to it that is your choice.
    Some areas do not have multiple soccer leagues for choice, so you can just choose to stay home because the girls league allows boys to play in it.

    To be honest I could really care less how some cycling club wants to be run. But I do firmly believe that when you offer a female division of anything, then it needs to be only females competing. If you are a trans then you can request a separate division be created or an open division for anybody to compete. I don't care nearly as much about some private club wanting to do things how they want to do it, but if they expect 501.3C status or some other tax benefit then they must comply. Why colleges and public schools should be required to comply.

    No one is talking about their rights. If someone wants to strip transgender people of lawyers, protection against self-incrimination, their ability to go to church or not, or force them to quarter troops in their homes at their expense, then I’m right there with you. Just calling something you want a “right” does not necessarily make it so, except in the Hobbesian sense. Playing competitive sports is not a right, and there are all kinds of rules in place to facilitate fairness for everyone. This is one more rule like that. I have a daughter who plays junior high volleyball. I only want her competing against other 11-12-year-old girls. Not young men who identify as girls. Not 18-19-year-old women who identify as 12. In my opinion, my daughter is more entitled to safe and fair competition than others are entitled to forcing her to play along with fiction.
