Just my opinion, but doctors should *not* be interpreting law at all, they should be following hospital guidelines. *If* there is one in place on this issue, then the patient should be referred to the people in charge of said policy. However, if there is *not* a guideline in place on this issue, then the doctor should ask the hospital to reach out to the state for approval or clarity or what have you. But in either case it shouldn't be the doctor's decision to make (unless it was strictly a moral issue, but that isn't what was discussed).

Please clear up how something can be viable and also have a fatal abnormality. If we can't clear that up, then I don't see how it passes the "viable" test.

Explain how I cram it down your throat.
By *gasp* voting my conscience? I mean outside of that, what am I cramming down your throat?

Now lets continue. List my "right wing" positions outside of abortion. Seems a guy of my "ilk" would be full of them right?

Still just curious if you pay attention.

The mud is taking shots at peoples faith. Debate the science. Shots at faith make it personal.

It's not your style generally so I don't think that was your intention, but just sayin...

Youve got to be kidding? you think a doctors should ignore the law and just follow hospital guidelines? So what would stop a hospital from declaring they do abortions up to 9 months?

As for the second part, you tell me why the legislature purposely wrote that part about viability as a qualifier to the exception on fatal abnormalities?

If the legislature followed your logic — which I agree with, btw, that all fetuses with fatal abnormalities are non viable— then there is absolutely no reason to put that qualifier in there … but they did… so they must not see it the way we do…

And if I were a doctor, I wouldn’t risk my license or freedom by pretending that qualifier isn’t there.

Yeah you are. I’m not going to get in to a convo about whether your (writ large) anti LGBTQIA agenda anti woke agenda, anti BLM agenda and anti abortion agenda is reasonable or not. It’s not. No interest in discussing it with you but I will call out nonsense like fetus is code word for baby. It’s right wing Christian code which has no meaning outside of your ilk.

This can’t be new to you you’ve had to have heard it from many people.

    No offense meant

“Viable” itself is a vague and movable term, based on medical advances. Right now seems like anything past around 16-18 weeks. That’s why doctors would be afraid at 23 weeks, even for a fetus with a severe and fatal anomaly.

In theory, in the not too distant future embryos could be completely grown in an artificial womb. That would make all embryos technically “viable”. That wouldn’t make it any less preposterous to treat the embryos the same as a human life. Let’s say a woman freezes a number of embryos and decides she doesn’t want them, or maybe only needs 1 or 2 but let’s say she stored 5. What happens, is she not allowed to have them destroyed? Will the govt force her to implant them? Seize them and give them to another woman? Grow them in a govt facility as wards of the state? There are all kinds of bizzaro dystopian repercussions it seems like the religious zealots don’t actually think through.

    Ah just as I suspected.

Could you cite my anti BLM agenda?
    My anti LGBTQ agenda?

(Hint: I have no issue with BLM and only requested they remove their slight on the nuclear family from their website, which they rightfully did btw)

(Hint: I have said numerous times that I take no issue with gay marriage from a legal sense and think adults should by and large chose what they wish with identities. As long as churches are not forced to honor marriage that violates their bylaws and persons are not forced to create content that violates their faith)

I think every business should serve and hire everyone equally with the only exception being the promotion of something that violates their protected free exercise of religion.

I have had multiple LGBTQ people work for me and they have been model employees and i judged them on job performance alone. I loved and cared for them as I do anyone else on ky staff.

As for woke? Have I even really ever used the term?

I mean people on your side here regularly accuse me of being a single issue voter because I agree with so much from the left on other issues.

Wanna talk about my health care position? Because the "right wingers" often hate my position.

Wanna talk about my view on taxing the rich?

You have a preconceived notion about those that arent in toe with your side.

Maybe thats why I dont want to leave the country like you do. I see the good on both sides and tolerate the bad.

That used to be a liberal talking point.

I think it would be prudent for any hospital to vet their guidelines (and for doctors to confirm that guidelines have been vetted). Some things are more obvious than others. But doctors should not be interpreting the finer notes of the legislation. 8-month abortion with no issues...not much interpretation required there. Calling a fatal abnormality within the confines of "viable?" That takes a creative mind, in my view.

By the way, I never said the doctor should ignore the law. Some issues are going to revolve around gray areas. Those gray areas need to be routed through the hospitals legal team so that each doctor doesn't have to provide his/her own interpretation.

I don't understand the question. I provided the definition of "viable" according to the law, from the same section, and I don't see how anybody can logically interpret that as coexisting with "fatal abnormalities." I'm obviously giving my amateur, non-legal, keyboard cowboy opinion, but I don't see how this doesn't at least get escalated to the hospital's legal team so that it's NOT the doctor making a legal interpretation. And *if* that was done, the doctor shouldn't be owning the decision but explaining that his decision is based on the hospital's legal interpretation, not his own (and again, contact information should be provided to the patient for additional clarity as needed).

Is this suppose to be an insult? Are you really insulting those with Down Syndrome?

Really sad if you are. But sadly par for the course. You really are special. In a sad way.

This young lady is so special and so much more of a person than you.

I said writ large. I don’t know all of your positions and I’m happy to engage them in different threads but one of them (inserting yourself into private decisions made in consultation with people close to them and or their doctor in the name of your faith) is odious. It’s reasonable to assume you have other odious position that infringe on my privacy and self determination.

How do you not understand the question… the law provides as an exception to the 15 week rule:

    (c) The fetus has not achieved viability under s. 390.01112 and two physicians certify in writing that, in reasonable medical judgment, the fetus has a fatal fetal abnormality.

Section 390.01112 doesn’t have the definition you quoted in it, and as I pointed out, if just having a fatal fetal abnormality was enough, then they could have written the law as …

    (c) Two physicians certify in writing that, in reasonable medical judgment, the fetus has a fatal fetal abnormality.

    Right?

Can you really the blame the doctor. I mean, the doctor says the baby could possibly survive a few hours outside of the womb… is that “sustainable”? How long is sustainable, what is “born alive”?

I'm not a "big fan". I do think he can beat Trump and is probably just playing his cards to do that at the moment. I will support him and wont feel disillusioned like when I bailed on the orange dude.

I would take a Romney, Pence or Kasich type in a heartbeat over him. I just said last week on this board that if Romney runs I will vote for him in the Primary.

The issue is I doubt they run.
