Donald Trump will be deposed under oath in a defamation suit brought by E. Jean Carroll, a writer who previously accused the ex-president of rape, a court ruled on Wednesday. US District Judge Lewis A. Kaplan denied Trump's request to pause the October 19 deposition, in the latest legal blow he's faced since leaving office.

Carroll wrote in her memoir that Trump raped her during an encounter in the mid-1990s in a Manhattan department store called Bergdorf Goodman. She accused Trump of defaming her when he denied her claims and cast doubt on the longtime advice columnist's credibility and motivation. He told The Hill in 2019 that 'she's not my type,' and suggested she conjured the rape allegation to peddle her book.

Carroll's lawyer Roberta 'Robbie' Kaplan told DailyMail.com of the judge's decision, 'We are pleased that Judge Kaplan agreed with our position not to stay discovery in this case. We look forward to filing our case under the Adult Survivors Act and moving forward to trial with all dispatch.'

The judge took aim at Trump's lawyers' attempts to delay the trial, a legal tactic the ex-president was known to rely on in times of trouble during his past life as a real estate executive.

I would still be surprised if it happened. That's an illegal analysis, just an observation of the fact that nothing goes according to rule with him. And if he does, I would expect it to be some type of performance, which will not harm him under his special chaos rules

Trump lawyers will argue law allowing writer to sue for alleged rape is invalid

Donald Trump plans to argue that a New York law allowing a writer to sue him over her claim that he raped her decades ago is unconstitutional, according to a court filing.

In a filing in Manhattan federal court this week, lawyers for Trump said they would move to dismiss the lawsuit filed last month by E Jean Carroll, in part on grounds that the law is invalid.

Trump denies Carroll’s claim that he raped her in a dressing room in the department store Bergdorf Goodman 27 years ago.

The former Elle magazine columnist is suing Trump for defamation and battery under New York’s Adult Survivors Act.

The law was spurred by the #MeToo movement, during which many women alleged sexual misconduct and assault by men in positions of power.

The Adult Survivors Act created a one-year period, beginning last month, in which adult victims of alleged sexual abuse can file lawsuits that otherwise would have been barred because the cases were too old.

Donalds empire is crashing in all around him. He may or may not go to jail but his empire is dying from a thousand cuts (law-suits),
when his cretin supporters finally figure out he does absolutely nothing for them and the cash drys up, the Donald will go the way of the rotary phone.

The irony of a man weighing 350 pounds with artificial orange hair saying “she’s not my type” about anyone because of the way THEY look makes me laugh out loud.

I would think that taking the 5th would harm him in a civil suit. My guess is he lies.

As well as if you look at pictures of her from the time she claims it happens, she is pretty much everyone's type.

Yep. She was very attractive. Found an old photo of my wife and I on the beach - we were maybe 23 - damn she was F.I.N.E. Fine. Reminded me of why we have grandkids. I was a raggedy boy. The years pass. Youth is beauty and beauty is youth.

If she walks and talks it is definitely Trump's type. Hell, maybe even if she doesn't walk or talk he might give it a go.

And if the political and media environment of 1974 were the same as those of today Richard Nixon would have served a full second term. First, a significant segment of the media would have portrayed Nixon as a victim rather than a perpetrator and perhaps much more significantly there would have been no way that that two-thirds of the Senate would have voted to remove Nixon from office. If he were impeached which would have been likely he would almost certainly not have been removed from office with the results being very similar to Trump's impeachment in 2019. Tragically the political culture of the US has devolved to the point in which loyalty to party and loyalty to one man takes precedence over the rule of law.
