Disney Sues Desantis

    In terms of what? Disney saying no? I'm pretty sure Disney was all in from the beginning up until Brightline chose the new corridor, that's when Disney backed out because the stop had moved much further north.

    We may be saying the same thing. What I was trying to convey (may not have) was that Disney would not allow a stop on property unless they were the only area stop. As I read these pieces, they could have a stop on property still but it would not be the only stop. But that was not acceptable. I guess it didn't kill it on the spur to Tampa (although the piece still seems to show no defined route)

    I understand what you're getting at. I'm not really sure, but it could have been an easy out for Disney to say, "well it's going further north so we won't be apart of any stops."

    With Brightline saying they'll still build a stop off of Disney Springs property once they get heading to Tampa, it could be that Disney wasn't happy about them not being the only stop so they dropped support for it, which is what you were getting at.

    Yea I was channeling Tampa officials who were pissed and thought Disney could have been compelled, including eminent domain, but for RCID.

    Probably a good idea just to avoid having a positive ruling for Disney overturned.

    I should also note that the chief judge who will pick the replacement judge is Mark Walker, an Obama appointee. I doubt Disney loses much with the change.

    It's not clear that he recused himself in response to a motion from a party. In fact, if I had to guess, without looking at the docket, I would guess he did so of his own initiative ("sua sponte").

    There are rules which require voluntary recusal without a motion based upon certain standards like being related. I'm not sure if they're triggered here, but again, I would not assume that anyone requested that he recused himself.

    And magistrates play a key role, but they don't make the ultimate decision. They usually try to resolve discovery disputes. But in the case of this magnitude, I would expect the Article III judge will be directly involved in all the decisions

    This isn't exactly correct. The district judge deciding the case, Mark Walker, is unchanged. When the case was filed, the magistrate recused himself. In my experience, Judge Walker doesn't refer many motions to the MJ, so it's unlikely to have an effect on the case.

    DeSantis can take this head-on. I think he’ll say words to the effect that “Florida can’t be bought, we don’t want woke investment.” And he means it. He would rather not have $17 billion invested in this State by anyone supporting gay rights and opposed to bigotry.

    The artistic cake decorating issue in Florida. Publix ultimately does the right thing, or at least articulates the just and defensible policy

    “I went and asked to speak with the bakery manager, and I asked calmly and politely ‘Just to be clear, you’re not able to write ‘Trans People Deserve Joy’ because writing that is taking a stance on something?’,” Flasterstein says. “The manager said that is correct and told me that they could write ‘People Deserve Joy’ and leave room at the top.”

    Flasterstein adds that the manager stated it was a policy from corporate and that it was out of their hands. Flasterstein had Publix write “People Deserve Joy” on the cake, leaving space at the top, and asked for extra icing. In the parking lot of Publix, Flasterstein wrote the word “Trans” on top of the cake herself.


    Flasterstein however did reach out and shared her updates with Watermark. In an email sent by its public affairs office, Publix offered “sincere apologies” and stated “We are often asked to create specialty cakes with free-hand designs. Our policy indicates that our associates may write statements that are not copyrighted or trademarked, support a charitable cause, are factual and considered to have a positive connotation. As we indicated in our Facebook conversation, our associates should have fulfilled your request.”


    Of course, Publix didn’t claim that they were shunning the marginalized because Jesus commands you do so.

    Well, I am finished with shopping at Publix if it believes that trans people should have joy. Does anyone know of any supermarkets that hate trans people?
