Classified documents found in Biden’s old office and garage, and other office, and residence

    A analogy much closer to the respective situations of Biden and Trump would be the comparison of a bank executive who inadvertently walks out of the bank with a pouch containing $1,000 in cash and then immediately notifies the bank that he was in possession of the cash that he should have never removed from the bank in contrast to another bank executive who embezzled $100,000 and denies that he has done so.

    Remember trump’s squeals of “witch hunt, witch hunt”, his refusal to turn over documents despite being asked nicely and privately over the course of many months, then bringing a lawsuit to a friendly judge, the appointment of the special master, the appeal, reversal, and ridicule of the judge who appointed the SM. I do.

    Some of Biden’s confidential documents date back to his days as a Delaware Senator. Some were found in the closet of an office on a college campus he has not occupied in several years. Not even in his home. Biden had over 8 years to return documents. Not like they were packed by team when he had to hastily move out of office at end of 4 year term. Had Trump been given 8 to 15 years to return documents like Biden, I’m sure he would have done so. If Trump had been given the option of the DOJ visiting after 8 years and helping review documents, I’m sure he would have done so. Biden had in 3 different locations rather than one for Trump. Why did the government not aggressively pursue Biden to return documents like they did with Trump? Why did the DOJ take pictures of documents and reveal them to the press for Trump and not Biden? Why did they cover up the Biden documents until after the midterm elections even though discovered earlier? President Trump can declassify documents as President, whereas a VP or Senator has no such powers. As such, President Trump could state he declassified the documents removed from office. It would be difficult to refute or prove otherwise.

    Senior Democrats, dismayed by a steady stream of startling disclosures, expressed criticism Sunday of how President Joe Biden handled classified materia l after leaving office as vice president and disappointment that the White House has not been more forthcoming with the public.

    Lawmakers who might have anticipated questions focusing on the debt limit or Ukraine aid when they were booked last week for the Sunday news shows found themselves quizzed about the latest development over the weekend in the document drama that has put Biden's presidency on the defensive: During a search Friday of Biden’s home in Wilmington, Delaware, the FBI found additional documents with classified markings and took possession of some of his handwritten notes, the president’s lawyer said Saturday.


    Biden should be “embarrassed by the situation,” said Illinois Sen. Dick Durbin, the second-ranking Democrat in the Senate, adding that the president had ceded the moral high ground on an issue that has already entangled former President Donald Trump. Special counsels appointed by Attorney General Merrick Garland are i nvestigating both cases.

    “Well, of course. Let's be honest about it. When the information is found, it diminishes the stature of any person who is in possession of it because it's not supposed to happen. ... The elected official bears ultimate responsibility," Durbin said.

    The fact Trump and Biden had the ability to potentially declassify the documents is irrelevant. There is a process that must be followed before a document is considered declassified. And until that process is finished, a document is considered the classification level marked upon it. Why? Simple. It is impossible to tell the difference between an actual classified document and an declassified document that has not finished the process.

    I also disagree that Trump, if given enough time, would have returned all the documents. He had plenty of time. 18 months, in fact, and 14 months after being notified by the Archives that the docs belong to the Archives, and need to be returned. That's 14 months, not 14 days or even 14 weeks, but over a year. How long does it take to set up a time for the Archives to come and retrieve documents? Certainly it can be done a lot quicker than 14 months!

    And remember, Trump lied about returning the docs on an affidavit. This shows intent that Trump wanted to keep the documents. Why else do you lie about returning them all? Maybe a mistake was made initially, but even after the lie was called out, and it was proven Trump had the docs, the only way the Archives could get them returned was through a warrant. And again, Trump had months to do the right thing, and did not.

    Also remember that the reason Biden had years to return the documents is nobody in the Archives knew they were missing. Judging by the fact that once one of Biden's team discovered the first set of docs, Biden quickly returned them and allowed the Archives full access to any place the docs might otherwise be located suggests that if the Archives had contacted Biden about these docs at any time, Biden would have cooperated then, and the docs would have likely been returned much sooner.

    None of this absolves Biden. He made a mistake and should not have had the docs in unsecured locations. Still, if we are to believe Biden and the mistake was simply a spillage of docs once located at his VPOTUS office and residence, and accidently moved to his new office and actual residence in Wilmington, then it is unlikely Biden will be charged with anything when you look at precedence in similar cases. Trump, on the other hand? Even if he isn't charged with having the docs, he might still be facing obstruction charges.

    Another poster that knows nothing about the Trump documents story.

    Trump was given 14 months to settle the documents situation in his possession. Only when he kept stonewalling did the government do anything "aggressive" aka executing a search warrant.

    Within 2 weeks of Biden revealing he had docs, a special prosecutor was assigned and not long after his home was searched.

    Mind you Biden didn’t really reveal anything. They were initially found(not by Biden) while an office was being packed up. Then oops some more were found after it was disclosed the initial files were “found”.

    It baffles me how someone in his position can have these documents literally scattered about in multiple locations under little or no control for years, and the defense an minimizing just goes on and on.
    Even some on the left are just shaking their heads.

    For the record, I don't give a rat's ass if Pence has classified documents provided that 1) he returns them and 2) he wasn't doing anything nefarious with them. Its becoming clear now that its somewhat common place for high level execs in the US government to not return classified documents when they complete their terms. A practice that needs to end.

    Obama is probably next.

    High level execs like the POTUS and VPOTUS receive a number of classified docs daily. There should be a process in place that after they are no longer in office, the Archives sets a day to do a search, but it should not shock anyone that a few pieces of classified information gets misplaced over the course of a 4-year, or 8-year term. It happens. And with both Pence and Biden, as long as they cooperate, and had no nefarious intent, then they don't deserve to be punished. Trump? Different story. Don't know the intent, but his actions were the opposite of cooperation.
