    Obviously speculation, Hur, the Special Counsel investigating Biden will most likely find that while Biden and/or his staff mishandled classified documents the requisite intent or aggravating factors necessary to warrant criminal prosecution are lacking. Jack Smith the Special Counsel investigating Trump may very well find the aggravating factors and/or intent were present and end up recommending prosecution. That being said Garland may still elect to decline actually prosecuting Trump based on the optics of an AG appointed by the president prosecuting a political opponent of said president. With Trump's skill at playing the victim an indictment could actually work in his favor in the run for the 2024 Republican nomination.

    Not really. Just saying that they while they might find wrongdoing on the part of the guy once known as "Individual One" Garland may decline to prosecute for political reasons. In the case of Old Joe the facts are completely different and it is very unlikely that Hur will recommend prosecution. The Espionage Act require intent and DOJ normally does not prosecute under other statutes regarding the mishandling of classified material absent aggravating factors.

    In the case of the classified documents, it’s more serious for Trump than Biden
    Most of the following apply to Trump, none to Biden.

    A stupid take, but that's to be expected.

    Past behavior is the best predictor of future behavior. Trump's entire adult life as a total scumbag doesn't afford him any benefit of the doubt ever.

    Say what you will about Old Joe he didn't lie about the classified documents nor did he blatantly make misrepresentations regarding the classified documents in his possession unlike a certain other politician who claimed victimization by the FBI because the Bureau searched the premises of his residence pursuant to a court approved search warrant because he lied about the disposition of the documents.

    No he just mishandled classified documents... which is exactly the crime Trump is being accused of relating to the documents.

    You can run cover for your boy all you want, he broke the law. In the real world, even if you apologize for something like that, even if you're transparent with law enforcement, there are real legal consequences. It must be nice having friends in high places.

    As it's been stated multiple times, the DOJ has prosecutorial discretion. And precedence in cases like these. And in general, intent, damage, and cooperation are what the DOJ uses to decide how to pursue these cases. Just committing the crime isn't a guarantee the DOJ will bring charges. Heck, even politics plays a part. The Special Consel might recommend charges for Trump, who did not cooperate, and none for Biden. But Garland may decide not to pursue either for political expediency. Especially if Trump is brought up on other, additional charges for Jan 6.

    Now Trump is claiming there were no docs. Only the folders, which were empty. Can he ever stop making excuses and lying?

    The article also reiterates the fact Biden has been cooperating from day 1. And Trump? 18 months of obstruction and lies.

    Had Trump cooperated from day 1, and returned everything without hassle, we'd probably not even care about Biden's docs.

    so he co-operated from day 1, which happened to occur right after the mid-term elections which might have been different if pinnochio joe was found to have violated the law and it was revealed before the voting. strange timing indeed on the " discovery "

    Standard Operating Procedure for the DOJ not to do anything that might interfere with an election 90 days prior. The exception was Comey making a Clinton email announcement just weeks before the 2016 election. By the way, the MAR search for the docs was 91 days before the 2022 mid terms.

    Nothing strange at all.
