Except we need the labor, so they'll never do that. Comprehensive immigration reform is the answer. Legalize the folks who are already here (especially Dreamers) who haven't committed any serious crimes, provide for a guest-worker system that has a pathway to legal status and eventually citizenship after a certain amount of time (if they stay out of trouble) to accommodate the labor demand, provide a lot of money for border security improvements (715 isn't wrong that we can use technology more effectively),* and step up the sanctions and enforcement on companies who try to sidestep the law.

* - While 715 isn't wrong about that, he is wrong in acting as if it will be a silver bullet. The border is never going to be entirely secure. It's just the reality of how things are. But if we have a system that rewards people who follow the rules and provides the needed labor, there will be less incentive for people to enter illegally to pursue economic opportunity.

 

We currently give out 140,000 worker Visas a year. Deport the 8 million undocumented currently in our workforce and replace them with legal visa holders only, it would take over 57 years!

The guest worker visa program isn't a cure all. But what is? Nothing. But the guest worker program is an improvement. I believe we shouldn't let good be the enemy of perfect. Show me a better plan that v won't cause mass inflation, mass GDP losses, splitting of families, etc., and I'll listen.

And me racist? Funny. These people come for the very same reasons people have been coming here since before we were a country. A better opportunity. How is it racist to offer these people a better life, and to educate their kids for free? It's exactly what they sign up for when they come here. And what immigrants have been signing up for when they agreed to indentured servitude. Today, that style program isn't legal, but immigrants keep coming.

And speaking of education, Hispanics are attending college at historically high rates. Double the number of students in the past 15 years. Hispanics are also climbing the economic ladder better than any other ethnic group. Which is also been an historical truth. Cesar Chavez was actually anti-immigrant. He was worried new immigrants would replace current one's kids, who would have no economic path for success. But this never happened. The kids all got an education and got better jobs than their parents, and never joined them in the field.

Again, we can learn from history and make choices that improve things. Or, we can ignore history and make the same mistakes we've made in the past and make things worse.

So what is the process for “presenting themselves”? Obviously one way is to illegally cross the border and get apprehended. Is there a legal way to present themselves? If so, why don’t asylum seekers do that?

 

The alternative process is showing up at a port of entry and asking for asylum. But the government instituted metering and essentially stopped letting people do that. The Obama admin are actually the ones who started it at a single port of entry in 2016. Trump expanded it, and Biden has largely kept it.

What is metering? Basically, a person who wants to seek asylum is told that there's a line, CBP will only allow X number of people to ask for asylum per day, and they must wait in Mexico until it's their turn. Unsurprisingly, a lot of people don't want to wait in Mexico for months (maybe longer) because they are at a much higher risk of being kidnapped, raped, tortured, robbed, murdered, etc.

What do they do? They enter illegally. Many of them actually enter illegally with the goal of turning themselves over to federal law enforcement to seek asylum. Issue is that entering illegally makes it much harder for you to gain legal status. Instead of going through the normal asylum process, you go through the expedited removal process. You can still pursue asylum or a claim under the Convention Against Torture, but you have less protections and the government has more power to deport you without offering much process.

EDIT: And to be clear, while their entry into the country would be illegal if they did not go through a port of entry, they can still legally ask for asylum if apprehended by law enforcement (or if they turn themselves in).
