    Why would the texts be privileged? They go back many years and weren’t necessarily to or from counsel.

    You almost have to wonder if it wasn’t intentional, or whether Jones tacitly approved it.

    I am not a lawyer but used to watch Perry Mason religiously. If he turned them over to his lawyers and then instructed the lawyers to ignore a judges ruling couldn’t that get the lawyer in trouble?

    Yeah, it might be contempt among other things if the judge actually issued an order. But it wouldn’t make them privileged, which is what the prior poster asked about.

    Well, there are really only two options here.....flgator2 is woefully uninformed or simply not telling the truth.

    @duchen, I'm a legal noob and correct me if I'm misinformed, but couldn't attempting to clawback something that was improperly withheld be problematic? After all, the phone data demonstrates the Jones camp did not fully comply with discovery during the trial.

    So here's how the phone data went down. A paralegal sent the wrong dropbox link to the Sandy Hook team. Jone's team recognized this and sent an email asking SH lawyers to "please disregard" the link.

    Apparently, "please disregard" request "creates no legal duty on me whatsoever" according to the SH lawyer. I guess they could have clawed back following proper TX procedure but failed to do so.

    How soon before "please disregard" becomes a snarky admission of failure on the internet?
