He's free to argue his interpretation, but it's still incumbent upon the judge to instruct the jury what the actual law is.
Which is exactly what she did. Judges interpret the law. Generally speaking, you don't get to boss around federal judges.
Unless you're an appellate court judge in which case you can boss a federal District Court judge. In civil cases if a trial court judge commits reversible error the aggrieved party has the right to appeal. Not so in criminal cases, once a jury is impaneled jeopardy attaches and the prosecution has no right to appeal no matter how badly the judge screws up. Maybe it's just me but it sure looks like Aileen Cannon is trying to put in the fix the indicted former president and she may have succeeded considering that Jack Smith has a limited number of options. https://www.salon.com/2024/04/06/th...nons-order-signals-bad-news-for-fate-of-case/ On the other hand Smith still has this option. Although it's difficult to force the recusal of a federal judge Aileen Cannon may have managed to cross the line. 'The nuclear button': Special counsel could seek removal of judge in Trump classified docs case, attorneys warn
The Constitution... It's just a piece of paper that some old people signed a long time ago, to some. For the rest of us... It's is The Law of the land by which governs the elected. It's We The People's protections from our "protectors" (the government) in real life.
Except when your preferred candidate chooses to enact a criminal conspiracy to overturn a presidential election? Do some of these people really say what they say?
Seems that way. I don't envy his position, because this fight was over before it started. They're not going to find 12 jurors in St. Lucie that have TDS. Judge will make sure of that. The real exposure was in Atlanta-Fulton and the DA blew that one up. You can't make it up...
Smith's only hope to not allow Cannon to earn her SCOTUS spot in Trump 2 is to get the 11th Circuit to recuse her. It's a high bar to reach, but they have already swatted her nutty rulings in Trump's favor down twice. She is basically trying to help Trump rewrite the law that presidents can leave office with any documents they wish to do with what they please including selling them to 3rd parties. The PRA only covers certain White House documents and does not cover for example CIA or NSA documents in the WH's possession.
Some belated disclosures. She is not alone. This is how right wing interests indoctrinate judges ideologically NPR's allegations about Cannon are part of a larger investigation into undeclared free trips taken by federal judges. The investigation, released on NPR's website on Wednesday, claims that "dozens of federal judges failed to fully disclose free luxury travel to judicial conferences around the world, as required by internal judiciary rules and federal ethics law." NPR alleges that "federal judges — occasionally with family members or even their dog in tow — traveled to luxury resorts in locations as far-flung as London; Palm Beach, Fla.; Bar Harbor, Maine; and the outskirts of Yellowstone National Park for week-long seminars. The judges received free rooms, free meals and free money toward travel expenses, together worth a few thousand dollars." It claims that some federal judges heard from a group that uses "lawsuits in federal court to change environmental policy, as well as from corporate CEOs in the oil and pharmaceutical industries."
The highlighted part is true, the rest of it is made up nonsense. Trump selling documents to 3rd parties? Are you really that ignorant of the facts? That's BS made up crap and you know it. Trump is winning this case so you better get used that fact too.
If former presidents are allowed to own the documents they steal from the White House, it logically follows that they are theirs to do with as they please. Frankly, leaving them laying around in boxes in a country club overrun with Chinese and Russian spies is barely any better than selling them outright.
That's far cry from being accused of spying for foreign countries and attempting to sell foreign government our secrets. I mean it's not like he's letting the Chinese into all of our national laboratories to get national military and rocket technological secretes like Clinton let them get away with. This case is now about the possible attempted set-up of president Trump by the FBI and DOJ.
Nonsense. He was advised multiple times by his legal counsel to return the documents to NARA and refused to do it hoping to make a fast buck from someone, somewhere.
The FBI had no legal right to break into Trumps home and that's why they changed the charges against Trump. From having classified document to spying... They knew they had no right to invade his home but they did it anyway. They even went though his personal documents and categorized them... that is called tampering with the evidence.
Well, he had documents belonging to the United States government that he refused to return. The FBI had a search warrant approved by a judge so I don't know where you are getting that they had no right to come get them. Also, there was no "break in" as Trump's lawyers were there overseeing the execution of the warrant.
No, he had every legal right to have them, the documents just happened to be about Biden and Obama's dirty dealings.
And nothing will happen. There is just no accountability anymore as partisan politics and the 24/7 news cycle prevent most anyone from being held accountable for their actions.
The only person walking on this planet that believes Trump had the right to keep America's nuclear and foreign policy secrets is Trump himself.
Every president had the legal right to declassify the documents that President Trump took with him. There is no legal requirement to notify HIS underlings about which papers he declassifies and takes.
