ABC to pay $15 million to Trump library to settle lawsuit, court documents show

    To be fair, it's not like they were deliberately "not reporting the truth."

    They just inadvertently referred to Donald Trump, the adjudicated and admitted sexual assaulter, as having committed "rape." Which, as the judge mentioned, he technically did, just not explicitly within the legal boundaries of this judgement.

    So again, it wasn't egregious or deliberate misrepresentation. It was just that in a strictly legal sense, when he was found to have jammed his fingers into a woman's vagina without her consent, in legal terms that was not considered a "rape."

    He inadvertently referred to Trump being a rapist 10 times. I guess 10 times is the new definition for inadvertent.

    I see your point - it wasn't just a slip of the tongue. Perhaps he was basing that on the statement of the judge.

    In any case, you are correct. Media should try to be accurate, and he should have instead said ten times that Trump was legally found to have jammed his fingers into a woman's vagina without her consent.

    Ultimately, I guess it would be a court. That is why you see all of the reports use those words: allegedly or supposedly, to avoid the legal problems.

    Yes. That is from when the judge dismissed Trump's defamation claim. That is the court.

    Correct. The jury was only given the then current NY statutory definition of rape to consider in their deliberations.

    Did Trump appeal the Court's ruling that what the jury found Trump to be liable for constituted "rape" under most definitions? I didn't hear anything about that ruling being overturned.

    I believe the jury found him guilty of sexual assault but not rape. The Trump legal team is appealing the decision from what I have read/seen.

    I think the jury's verdict was that he committed sexual "abuse." I was curious about any appeal of the Court's subsequent ruling regarding the characterization of the conduct as "rape" based upon common definitions.

    The only appeal I am aware of is the Trump legal team appealing the decision based off of some of Judge Kaplan's rulings.

    I believe the appeal is pending. Trump apparently filed a post judgement motion attacking the verdict as I outlined above. The language about his conduct constituting rape by its common (non-statutory) definition was in the order denying Trump's motion.

    Heard an interesting theory on the Commentary Podcast. They were suggesting the ABC settled the suit to protect their on air talent from discovery. Their lawyers probably pointed out that ABC News division did not want to have to turn over their internal communications about Trump over the last two to four years. I'm sure there are a lot of things being said by their on air talent that were not flattering about Trump or the On Air talent. That would give the incoming Admin a nice stick to beat ABC News with any time they were critical of the Trump Admin.

    If you look at it from that angle, settling make a bit more sense.

    Listen here, Mr., this case is 100% civil case and NOT a criminal case... Do you want to know why? Because the statute of limitations expired on any sort of criminal case, so the STATE OF NEW YORK (seems illegal to me) changed their statute of limitations just so she could sue for money in a civil case for defamation or character.

    The state of New York could NOT change their statute of limitations for a criminal case against Trump because that would clearly be against federal law.

    So this is NOT a criminal case. That court case against Trump is and always will be known as a civil case. I'm pretty sure battery would be a criminal case. So, you are WRONG.

    Ex post facto - Look it up.
