A first amendment case out of Alabama

    This is what I taught my sons. When pulled over always be polite to the cop no matter how big of an asshole he is. The goal is to survive and pay the ticket. It doesn’t make cops and judges being scum right or what we as a society need to put up with.

    As as a final thought. I also am skeptical of a story told by the defense attorney that this appears to be. In time the truth will come out.

    Seems like two egos got the best of two dudes.

    The issue is with this judge. Probably hates yutes. Where is Vinny Gambini.when we need him? Any word if it was a '64 Skylark?

    Obviously, we shouldn’t have to walk on egg shells to feel safe. But just as obviously, it is pure COMMON SENSE to show respect. I certainly understand that sometimes the heat of the moment impedes the obvious common sense behavior, that’s human nature. And police know this, too. But all things considered, when you don’t show that respect, you’re exacerbating the opportunity for trouble.

    Frankly, my take-away from this is that the system of electing judges is stupid. The judge here is just pandering because he knows the order won’t hold up on appeal. But look how cool he looks to the electorate.

    I think you would get this from unelected judges too. I remember one of the seasons of the Serial podcast, there was an infamous judge in Cleveland known for being very paternalistic and talking down to people on trial, he'd been on the bench for decades, and the courtroom was like his own personal fiefdom, and the advice attorneys gave clients was just "let him do his thing" because he was actually kind of lenient in sentencing if you didnt challenge him. I'm guessing there are plenty of imperious judges who are like that and arent lenient, its pretty insane that we give judges such power to begin with.

    As usual, you’re on the side of the disrespectful.
    I was respectful to all my teachers as well…even the asshole ones.
    It’s not so hard to be polite to an officer of the law.

    But seriously…can you imagine your own child telling a cop to move your ass.
    And then on top of that…your child refusing to just say my bad man.
    The fact that this is even a debate is ridiculous.

    No. I cannot imagine that. BUT, in the moment, tempers flare and people do things we’d never think we’d do. And then there are resulting consequences.

    My concern is that he is talking about throwing him in jail for something he wasn’t charged with, and doesn’t fit the definition of obscenity. If he were charged with obstruction or disorderly then sure. He wasn’t, at least based on what I read. The judge can’t create a rule from the bench and throw you in jail for it. That should concern everyone.
    And I’m not saying the guy couldn’t have handled it better, I’m only saying the judge doesn’t get to throw someone in jail for being a bit rude, especially when it’s after a stop is over and after the official police business was done, and after he had supposedly asked him to move twice politely so he could be on his way. That’s an absolutely awful precedent if it’s as portrayed. The guy will eventually win on appeal, unless the body cam footage (if it exists) shows something else.

    I have always said we need to pay cops more have fewer of them and then with the higher pay hold them to higher standards. This cops Douchery in blocking a guy wanting to get out would result in his removal form the force in my utopia.

    You used to have a better memory.
    Recall…I was no goodie two shoes in high school. I played ball in some rough areas with good b ball players. I could relate and get along with very poor folks as well as those who lived on the lake.
    If you were an asshole, you’d get your ass kicked quickly.
    Oh, and my parents taught me to be respectful to adults.

    Yeah, most parents do. Eventually most kids get old enough to realize respect is earned, not given - that its a two way street. But a lot of people in positions of power think they can put on the uniform or badge and they are entitled to respect no matter how they act. They use their power to force apologies or show they are in charge, basically they act like a parent dealing with a toddler instead of an adult or equal. While the path of least resistance is often a better strategy dealing with them and not complicating your own life, when someone does stand up to them, I'm not going to mind it, I will even applaud them for it.

    I get it now.
    You like powers struggles.
    I’m fine allowing others to feel good about themselves…especially when they’re doing a difficult job that I don’t want to do.

    lol and I bet you were a lil snitch in school trying to up your teacher's pet points.

    Do you think that woman who was held face down in the fire ant bed should be nice to those officers? The guys who had barrels put in their mouths should be polite to those officers? Should people be polite to officers that show up at 3am to execute a warrant in retaliation for filming a cop speeding on the highway to get a better spot in the drive-thru lane? Not every officer deserves respect just because they are a LEO. Some are, in fact, giant assholes who are simultaneously super tough guys and sensitive lil bitches.

    Also, you have a little blue around your mouth. You might want to go clean that up.

    Some people don’t like to be told what to do. lol
    You’ve probably had a few experiences struggling to gain power or the perception that you held control over someone. I hope it makes you feel better…lol.
    It doesn’t bother me that cops are often assholes…some people deserve what they ask for though.
    You do not seem capable of understanding how difficult a cops job can be. That’s something you ought to look into.
    Be polite, obey the law and go back to your normal miserable life.
    It’s not that hard.

    Being a cop isnt difficult, you mostly get to sit around in your car all day, collect free fast food and scammy overtime, and retire at 50 on the public's dime. Being a judge is even less difficult. If its an elected or appointed position, you dont even really have to understand law lol.

    Agree 100%. But the problem is not the % of “bad apples”, but the culture of permissive cover up.

    Also, one Twitter commentator made an interesting point. A bad cop is defended as an individual unrepresentative of the whole, despite the fact that they are supposedly formed and trained as a cohesive force.

    A random attendee at a demonstration, esp. a pro-Palestinian demonstration, that shouts something anti-Semitic, is deemed representative of all at that protest and nationwide, justifying violent repression
