    A 19-year-old U.S. citizen arrested by Customs and Border Protection agents earlier this month in Arizona and briefly prosecuted for illegal entry into the U.S. has intellectual disabilities, his family told CBS News.

    Jose Hermosillo was arrested on April 8 by CBP in Tucson and detained for 10 days. His family provided documentation proving his American citizenship, days after being taken into custody, according to court records and Department of Homeland Security assistant Secretary Tricia McLaughlin.

    On Monday, the Department of Homeland Security argued his arrest, which has attracted national attention, was a "direct result of his own actions and statements." A DHS spokesperson said Hermosillo approached a Border Patrol agent, said he had entered the U.S. illegally and identified himself as a Mexican citizen.

    So a US citizen that's mentally disabled is arrested by CBP and is held for 10 days.

    You must have missed the part where he said he was a Mexican citizen. Are you suggesting that DHS is to assume everyone is intellectually disabled and should therefore ignore what they are being told?

    Reading the story it seems to me most of the blame should be aimed at the boys family if they are arguing that he has intellectual disabilities. Shouldn't they be looking after their disabled son?

    It’s because of shit like this that I make my teenage kids carry a photo of their passport on their phones. Freedom baby!

    no proof he was american. He said he was an illegal mexican.

    Thats what the cops say, and cops lie all the time. Why should we trust the people detaining anyone that looks too brown to them?

    A DHS spokesperson said Hermosillo approached a Border Patrol agent, said he had entered the U.S. illegally and identified himself as a Mexican citizen.

    The department also posted a copy of Hermosillo's sworn statement on X in which Hermosillo responded "yes" when asked if he had entered the U.S. illegally. The document shows a child-like signature that reads "Jose."

    The point is they could have put anything in front of him and he signed it. Something tells me the signature wasnt the only tip off that this guy wasnt of sound mind.

    They also lied about where he was arrested. I don't trust anything they say

    There is no proof he said he was not a citizen. You dont need papers to walk around.

    The guy signed the papers saying he wasn't a citizen because he was told to do so. He didn't have the mental capacity to understand he didn't have to. When asked where he was from originally, he answered New Mexico, but the ICE agents didn't believe him. And then arrested him.

    I did not lie to the police.....The officer appreciated that I pulled over and waited on him even before he turned his blue lights on. He knew I could have easily just continued driving but I realized I had turned into the wrong lane in front of him I knew if he had to come after me he would have endangered others and probably wouldn't have caught up to me. As for the seat belt I buckled it while he was still at the light and I was pulled over waiting on him. He didn't know I wasn't wearing the seat belt. I was also very polite and apologized for my mistake before he even said anything.

    My point in that thread was, if you cooperate and do as you are supposed to do you probably won't get arrested. As opposed to someone saying "I didn't do nofin man, why you doin' this to me".

    So you guys want to take his word as truth but cops lie? LOL I'd be willing to bet 99% more perps lie than cops.

    I take the word of his family that he is not all there mentally, and signed the paperwork stating he was illegal because he was told to sign everything. Why would the family lie about his mental abilities?

    He never should have been arrested. He originally answered he was from New Mexico. That should have been the end. But ICE didn't believe him, even though he told the truth.
