Trump administration concedes Maryland father from El Salvador was mistakenly deported

    He said he'd provide a plane but has not had to yet because El Salvador said they won't release him. Trump could do other things like withhold money but he's not required to do anything but facilitate and he did that with his declaration the he'd provide a plane. Not sure the value in going back and forth on this. You're always going to side with illegals being allowed to stay here so not surprising you would want to bring more into the country.

    I side with the Constitution, and the due process protections the Constitution is supposed to provide. The SCOTUS has said Trump denied Abrego Garcia his due process, and ordered Trump to facilitate AG's return. It doesn't matter AG's legal or citizenship status. The Constitution guaranteed him due process, and Trump denied it. And instead of doing everything to ensure AG got his Constitutionally guaranteed due process, Trump has maybe done the bare minimum? Again, his bare minimum offer of a plane may not satisfy the court order.

    Why are you against persons receiving their Constitutionally guaranteed due process?

    So you’re at least acknowledging that Trump did the bare minimum. Seems like that falls under “facilitate”.

    We'll see if the courts agree. I'd guess that offering a plane to return him while simultaneously continuing to pay El Salvador to keep him incarcerated won't meet their standard of "facilitate."

    but the question was raised on this board, I assume to seek the opinion of people on here. If people wanted to know if the courts agree then that question should probably be posted on some other forum like reddit ;)

    Illegals aren't guaranteed due process. They get an executive hearing. No trial.

    The J6ers didn't get due process. They got corrupt judges, hugely biased TDS juries, no change of venues, were not allowed to present evidence crucial to their cases and there was a 100% conviction rate.

    AzCatFan cares more about illegal gang members than traditional Americans opposed to election fraud. That's how it will always be with him.

    It's in the Constitution but I bet AzCat won't like this:

    Not my decision to make. I would say no. Facilitate means make easier. Trump could make AG's return easy by stopping payment until AG is returned. Trump didn't do that.

    AG had his immigration hearing. It ended with him having protected status and him being in the country legally. Can anyone show me where Constitutional due process differs between citizens and immigrants? Especially when the migrant has legal status?

    And what part of due process did the J6ers not get? The right to face their accusers? Right to see all evidence against them? Right to a jury trial made up of their peers?

    Sure, argue none of them were found innocent. Big deal. The evidence against them included hours upon hours of video evidence from multiple sources. None were found innocent because the evidence against them was overwhelming.

    This is an extremely weak argument. Due process doesn't always mean jury trial. But it does mean, as the ruling states, a hearing with an "executive officer."

    Abrego Garcia had an immigration hearing in front of one such officer. In 2019. And that judge put an order of protection on AG allowing him to stay legally in the US.

    The protection order also meant in order for AG to be deported, it would require another hearing. A hearing that AG was denied, and a major part of the Supreme Court ruling that Trump needs to facilitate AG's return. As stated in the SCOTUS ruling, Abrego Garcia was denied due process when he couldn't defend himself in front of a judge. And just a judge; no jury needed. Thus satisfying US v Toy.

    Trump has carte blanche to enforce the Alien Enemies Act as passed by the legislative branch. As I see it no judge can prevent him from doing so. Period.

    Tell that to the Supreme Court. They disagree. 7-2. And even Alito in his dissent warned Trump he must follow the law.

    According to Senator John Kennedy, Abrego Garcia has appeared before 17 judges (some of them twice) at a cost he estimates to be $5,000,000. To deport 1,000,000 illegals at that rate would cost $5 Trillion dollars. Deporting 10 M illegals would cost $50 Trillion

    So the corrupt and lawless Democrats fund the importation of illegals into the US with taxpayer dollars that go to NGO's that are often run by their friends and family. Some of the money is funneled back to Democrats in the form of campaign donations. When Trump tries to deport the illegals the illegals lawyer up with Democrat lawyers at taxpayer expense.

    Nice racket the Democrats have. To keep Republicans quiet the Dems throw them a few bones.

    Now for some important context. Most of the times AG went before an immigration judge were for regular check-ins, which were a requirement for his 2019 decision. These check-ins ensured AG was staying out of legal trouble and employed regularly. Because had he been causing issues, a judge could revoke the protection order and have him deported.

    AG was living up too his end of the agreement. No arrest record, steady employment, and never missed a check-in date. The restraining order was cause for possible concern, but according to the wife, handled with counseling, and only a 1-time incident.

    The Federal Government, however, did not live up to our end of the agreement. We deported AG without due process, and against his protection order to stay. That's why the Trump admin has been ordered to retrieve him.
