meanwhile, a win for freedom of the press. just shocked that they even tried it

Judge orders White House to restore Associated Press access after Gulf of America dispute

A federal judge on Tuesday ordered the White House to restore the Associated Press's access to key presidential events, ruling the Trump administration violated the First Amendment by barring the outlet over its refusal to adopt the name Gulf of America, formerly the Gulf of Mexico.

U.S. District Judge Trevor McFadden, a Trump appointee to the D.C. Circuit, said the government cannot deny access to journalists “because of their viewpoints,” siding with the AP in a 41-page opinion that hammered down on long-standing principles of press freedom.

“About two months ago, President Donald Trump renamed the Gulf of Mexico the Gulf of America,” McFadden said. “The Associated Press did not follow suit. For that editorial choice, the White House sharply curtailed the AP’s access to coveted, tightly controlled media events with the president.”

“The AP now sues the White House chief of staff, her communications deputy, and the press secretary,” McFadden continued, “seeking a preliminary injunction enjoining the Government from excluding it because of its viewpoint. Today, the court grants that relief.”

When the judges order is vacated and he has to cancel his scheduled meeting with both sides, it is a smack down.

when a technicality is noted as a reason to vacate a stay along with direction on how to cure that technicality and then the justices also note that the substance of the case is valid, that is not a smack down in my world, but you do you

the detainee is covered under due process. show the evidence he is a threat or release him.

what is that called? it's called winning the war.

    the procedural issues are battles

whether people of all opinions or legal status are entitled to due process is the war

even in your "smackdown" all nine justices agreed that the people were covered under due process. that whole constitution thingy that stands in the way of authoritarianism

Judge tells government to provide evidence, or case against Columbia student Mahmoud Khalil is over

An immigration judge in Louisiana said she would terminate the case against Mahmoud Khalil if the government does not provide evidence this week justifying their attempted deportation of the Columbia University student activist.

At a hearing Tuesday in Louisiana, Judge Jamee Comans gave the government 24 hours to provide evidence showing that Khalil, a 30-year-old legal permanent resident, should be expelled from the country for his role in campus protests against Israel and the war in Gaza. If the evidence does not support his removal, she said, “then I am going to terminate the case on Friday.”

Supreme Court Chief Justice Roberts swoops in to save Trump firing decision

Another decision out of the Supreme COurt backing Trump and one of his decisions. It sure seems like the SCOTUS is favoring the Executive branch in these battles with unelected district judges.

And who would have predicted this!

Checks notes ...... oh yeah, this is the group of which 1/3 was appointed by the felon Trump. Who prevented Trump from going to trial over grand jury indictments for very clearly trying to overturn a lawful election.

Fascinating to see cheering for a criminal's victories over the rule of law.

    But sadly, not surprising.

Are you saying the Chief Justice's ruling is against the rule of law?

I'm saying that, as we all clearly know, Donald Trump is a criminal. To cheer for Him in any capacity is to cheer for a criminal.

another unsigned, unreasoned, temporary stay that does not address the core legal argument..guess that's a smackdown these days

Supreme Court Chief Justice Roberts swoops in to save Trump firing decision

The brief stay issued by Roberts is not a final ruling on the reinstatement of the two board members, National Labor Relations Board (NLRB) member Gwynne Wilcox and Merit Systems Protection Board (MSPB) member Cathy Harris, two Democrat appointees who were abruptly terminated by the Trump administration this year.

Both had challenged their terminations as "unlawful" in separate suits filed in D.C. federal court.

But the order from Roberts temporarily halts their reinstatement from taking force two days after a federal appeals court voted to reinstate them.

If he is not subject to deportation even with actual due process I wonder if he will sue the ever living hell out of the government.

Wow - hilarious that Rubio got roped into this cluster**something.

To be fair though, this is precisely what the lying Trump Administration wants and sought from this; a political football to convince their cult that they are actual doing something -and being resisted- on immigration.

This is part of the perfect fake solution that they needed to satisfy the cult. Couple it with their fake "mass deportations" of criminals (which net somewhere less than 1,000 deportations?), while net numbers are pretty static, and they've got their dishonest narrative locked up.

Which, of course, is as much "winning" on the issue as they ever planned to do. (I wish there were a betting market on how much "solving" they'd get done on the illegal immigration issue.)

    like this

might want to let Ben know that Rubio doesn't get to decide without due process. maybe he missed the news

Supreme Court rules Trump administration must return Maryland man mistakenly deported
In the majority opinion, written by Justice Sonia Sotomayor, the court ruled that Kilmar Armando Abrego Garcia was illegally deported from the U.S. and must be returned.

Abrego Garcia had legal protection from deportation under an immigration judge’s 2019 ruling that shielded him from deportation to El Salvador, where he faced likely persecution by local gangs.

"The United States acknowledges that Abrego Garcia was subject to a withholding order forbidding his removal to El Salvador, and that the removal to El Salvador was therefore illegal," the court ruling reads. The Trump administration alleged that Abrego Garcia is a member of MS-13. Abrego Garcia has denied the claims, saying that he has been in the country legally for the past 10 years and has no criminal record.

In the opinion, Sotomayor said the government has not provided an adequate legal argument to support Abrego Garcia’s "warrantless arrest, his removal to El Salvador, or his confinement in a Salvadoran prison."
