    Beats me. Not to my knowledge. And it doesn’t matter. The result will be the same. The text of the 22nd Amendment reads as follows:
    It does not say no person “can talk about,” “can run for,” or even “can be nominated by their party” for a third term. It says “no person can be elected more than twice.” Which means if I’m a Democrat, there’s nothing I would want more than Trump (assuming he’s not moved on in some other sense, of course) to run again in 2028. I would campaign as if he wasn’t even there: no debates, no criticisms of his Administration, only talking about what I was going to do when I took office. On election night, I would declare victory as soon as the polls close, regardless of the results. And if Trump somehow got more electoral votes I would just dispassionately request the Supreme Court rule on the 22nd Amendment and start making my Cabinet announcements.

    NBC’s Kristen Welker asked Trump if one potential avenue to a third term was having Vice President JD Vance run for the top job and “then pass the baton to you.”

    “Well, that’s one,” Trump responded. “But there are others too. There are others.”

    Yes, I suppose that’s true. That’s a way around the “can be elected” language. Of course, if you’re Trump, then that requires Vance voluntarily giving up power. That is much to ask of any mortal man. But it also sounds like an argument the Democrats would have to convincingly make in 2028. And that is just straight-up democracy.

    To be honest, I don’t like it either. Just like I don’t like his language about bringing in Greenland “one way or another.” That’s why as a free person in a constitutional republic, I celebrate the constitutional backstops we have to stop the worst excesses of a person in power. But if we actually invade Greenland or Trump actually gets elected to a third term, then I’ll be the first person in here to say that I was wrong and that our Constitution was insufficient.

    Could be. But at a certain age a person faces greater risk from over exertion while on the proverbial throne than they do from being thrown in prison.

    Not a joke at all. Under your scenario, Vance would be the constitutionally elected President with no obligation whatsoever to step down and let Trump take over nor even to take his advice on any subject. Vance would be perfectly within his rights to send Trump on an extended tour of “shithole” countries till he drops dead of dysentery. And while I can think of a few good reasons for Vance to agree to the plot you described, I cannot think of one good reason for him to follow through on his part to resign five minutes after inauguration.

    They mos def would try it. Project 2025 essentially mandates break all laws, see if it can be stopped.

    But he’s basically half-dead right now. Won’t make it.

    I used to agree with you. But as I watch MAGA operate these first few months, I have less and less faith in the constitutional backstops in place.
