    Kiffin, Ole Miss ask to dismiss player's $40M suit

    The player has never been dismissed from the team and is still on scholarship.

    There is no discrimination because no white player has ever asked for a "mental health break" under Kiffin. So no one has been treated differently.

    Ole Miss, Lane Kiffin Lawyers Argue for Dismissal of Player Lawsuit

    Rollins alleged that defensive line coach Randall Joyner urged Rollins to transfer in a meeting last November. After Rollins chose to remain at Ole Miss, the lawsuit alleges Rollins informed Kiffin he was going to “take a mental health break because of the verbal abuse from Kiffin and the mental anxiety, depression, and worthlessness he was feeling.”

    According to the lawsuit, Rollins sought counseling from an athletic department psychologist and confided in other staffers before arranging another meeting with Kiffin in March.

    “I don’t give a f–k what your mom says or what you think. In the real f—ing world, you show up to work. Then you say, ‘Hey, I have mental issues. I can’t do anything for two weeks,’” Kiffin purportedly told Rollins at the meeting. “… What f—ing world do you live in?”

    My understanding is that Kiffin requested a meeting with the guy. His response was to tell the party that relayed the message that he “wasn’t ready” to do that. Then showed up 2 weeks later and recorded the conversation. It was nothing more than a trap, set by the player, to bring a lawsuit against the school.

    Is recording a conversation without the other party's knowledge still a crime? Or is it just a phone thing? I think it used to be, but I can't recall the last time anyone mentioned it.

    I like your post tiegator but, real justice would be served by charging the plaintiff and his attorney 10 grand or so for wasting the court’s time.

    It’s legal most places as long as one party consents. In this case, the kid recording is obviously the consenting party.

    Depends on the state. Mississippi is one party consent. There are a few states that are two party consent.

    Eleven states require the consent of every party to a phone call or conversation in order to make the recording lawful. These "two-party consent" laws have been adopted in California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania and Washington.

    Thanks...1 party consent doesn't make a lot of sense, but then again, I guess its so a 3rd party can't record without a valid warrant. Does this apply to video as well....I'm assuming no.

    I don’t know if there’s any restrictions on video. I think it only applies to audio. Although a lot of businesses do have signs that say video cameras in use.
