I know some of you here will say that’s BS, but there are possible legs to this lawsuit, which is actually a counterclaim, because he’s using the same theory against Carol, that Carol is using against him. I believe his claim is a bit stronger than hers. Her claim, from what I recall, is based upon his denial of her charges. There has to be more than that because that claim is rather stupid IMO. No, the court (jury) found in Trumps favor on the rape claim. The Trump defamation claim is based upon her accusations that Trump raped her. The jury’s finding will be used against her now. It is a standard text book case. Her defamation claim is not a standard claim from what I remember and read.

I freely admit I’m not a lawyer so not claiming to be an expert, but they found him liable for sexual abuse no? So his lawsuit is going to be “I sexually abused her but didn’t rape her, so she’s lying and owes me money”? Just don’t see how that would ever happen, a jury that would reward a guy against the woman he sexually abused. But maybe I’m proven wrong

I would 100% file this lawsuit if I was Donald Trump, because she's a nutcase as evidenced in her notorious interview with Anderson Cooper where she walked back the rape claim and then stated most people think of rape as "sexy." I think AC was literally pissing in his pants. Notwithstanding the jury's unanimous finding that he didn't rape her. I would hope all of you would do the same if some nutcase woman tried to ruin your life with such false allegations. Even if Trump gets the most favorable ruling, with the highest reward, there's fat chance he'll see a fraction of that award and whatever fraction that is, he clearly doesn't need to line his pockets with. His popularity (or lack thereof) isn't going to change regardless of the outcome. But either way, out of principle, 100% of the time, I would sue. She's a loon and loons shouldn't be allowed to take egregiously false allegations this far.
So if a jury somehow determines in Trump's favor, they would decide how much additional defamation damage may have occurred due to claims of rape vs already determined sexual assault. Sounds to me like give the man back $10.00 and we're done.
You are not at any disadvantage discussing trial by not having legal training. Nothing he does has a need to do with any cognizable legal standard. BTW, he just deposited the judgment sums. This is a legal measure you need to do to avoid having her executing on his assets while he appeals. He's basically deposited in the amount so that she's protected and can recover after the appeal she prevails, which she should, statistically.

Sexual assault, and rape are not the same thing. This is why this woman filed both claims against Trump. They are not the same thing, and she cannot claim that they are the same things since she herself filed them separately, as separate claims.
