The website, according to the FBI: RentAHitman.com. But RentAHitman is a fake website whose owner relays tips about possible murders-for-hire to law enforcement. On Thursday, a day after FBI agents arrested him, Garcia was charged in the U.S. District Court of Middle Tennessee with using interstate commerce facilities in the commission of a murder-for-hire. He faces up to 10 years in prison if convicted, prosecutors wrote Friday in a statement.
I’m sure that will be a possible defense raised by his counsel. I just cannot get over the man’s belief that Rent-A-Hitman was real and would find employees on the internet.
The most embarrassing thing is this ”entrapment site” is not close to new. They got some woman trying to order a hit on her husband, this was YEARS ago. As I recall the site wasn’t created by the FBI, it was created by a prankster, who then realized some people were actually serious. I guess by now he just automatically forwards the occasional moron to law enforcement.

The defense might argue it, but that will be a tough sell. Florida's statute: 777.201 Entrapment.— (1) A law enforcement officer, a person engaged in cooperation with a law enforcement officer, or a person acting as an agent of a law enforcement officer perpetrates an entrapment if, for the purpose of obtaining evidence of the commission of a crime, he or she induces or encourages and, as a direct result, causes another person to engage in conduct constituting such crime by employing methods of persuasion or inducement which create a substantial risk that such crime will be committed by a person other than one who is ready to commit it. (2) A person prosecuted for a crime shall be acquitted if the person proves by a preponderance of the evidence that his or her criminal conduct occurred as a result of an entrapment. The issue of entrapment shall be tried by the trier of fact. Reminds me of a scam a buddy of mine used to run back in the 80s. His daughter worked at Pizza Hut and if someone called in an order and failed to pick it up the manager would let one of the employees take it home. Every Friday about a half hour before closing time an order would come in for a couple of pizzas just the way Bert liked them. Of course nobody would pick them up and Berts daughter would bring them home to him......What a nice lesson to teach your children.
In very simple terms, if a law enforcement agency only creates an opportunity to commit a crime for an individual already predisposed to do so it's not entrapment. If the law enforcement agency takes affirmative steps to induce one to commit a criminal act it's entrapment. The situation in this thread seems to be right on the line.

Where is the inducement in this situation as opposed to merely providing the opportunity? From the website's homepage: "We are 100% HIPPA Compliant (Hitman Information Privacy & Protection Act of 1964)" How stupid can people possibly be?
