South Carolina court rule state constitution protects abortion

    Well, while everyone was watching the Speaker craziness in DC Friday… South Carolina courts ruled that abortion was a protected right.

    South Carolina Constitution Includes Abortion Right, State Supreme Court Rules

    The South Carolina Constitution provides a right to privacy that includes the right to abortion, the state’s Supreme Court ruled on Thursday, saying “the decision to terminate a pregnancy rests upon the utmost personal and private considerations imaginable.”

    The decision overturns the state’s law banning abortions after roughly the sixth week of pregnancy. More broadly, it is a victory for abortion rights in the South, where states have severely restricted access.

    It is the first final ruling by a state Supreme Court on the state constitutionality of abortion since the U.S. Supreme Court overturned Roe v. Wade in June, which ended the right to abortion under the federal constitution that had been in force for half a century, and left the matter to the states.

    Abortion rights groups responded to that decision by filing suits in 19 states, seeking to establish a right to abortion under state constitutions, in many cases citing explicit provisions in those documents protecting a woman’s privacy and equal rights. The South Carolina case was a critical first test — and success — for that strategy.

    That word that many saw above (before edited) is akin to a slur to some folks.

    If my middle schooler ever uses it, he will wish he had cursed instead.

    While I agree with the decision and think S. Carolina got it right, isn't this exactly what the fed supreme court intended to happen? Make it a states rights issue?

    I do not think that is nor should be the SC's role in our gov. They should decide whether something is or is not constitutional...HARD STOP.

    It would have been much easier if the US SC would have ruled that way but the issue is not whether "abortion" is legal or not, but whether your right to privacy is legal. It should be and while my interpretation of the US constitution says that right is in there, the US SC said it's up to the states to decide if their state constitution provides for a right to privacy (not a right to an abortion). If enough states courts rule that way, it will again be the law of the land nationally.

    It will probably take 3-5 years to simply appoint State Supreme Court hacks to simply overrule this court in the future on a very similar case. Just happened in SCOTUS so Im not betting any of these rulings are safe for long term. Courts are effectively politicized by conservatives.

    Less than that. It was a 3-2 decision. One of the three is retiring this year. The Republican SC Legislature will appoint the replacement.

    I wonder if there will be a day when abortion will no longer be such a controversial and discussed topic. To be honest, every day, I see posts about it. And both supportive posts and those which say that abortion should be illegal.
    I don't want to say who is right and who is wrong, but I support that right and think that abortion should be legal, and it's up to each woman to decide what to do.

    Adding that your definition of "baby" would include a zygote roughly the size of the head of a pin. I would also add that to protect "babies" prolifers are apparently willing to sacrifice the lives of adult women.
