    This is a tough issue.

    On one hand, he's right but on the other hand will the water raise all the boats if some of the boats are held down by shorter anchor chains.

    Its another political divide where both sides should probably work better together to solve these things.

    I'm a fan of the most qualified should get the "prize" but its not always that simple.

    It's really disgusting the way "conservatives" have bastardized the Reconstruction Amendments, which were aimed at achieving real equality for Black people, to undermine that objective. Unfortunately, the Republican ideologues in the judiciary are all too happy to play along and play stupid because it is convenient to their politics.

    Quotas are not necessarily economically efficient.

    But then again neither is discrimination and segregation. Not sure what the Biden admin is requiring, but I’m betting it’s a relatively low bar that this guy is failing to meet or doesn’t want to meet (because reasons).

    I just read the article. It's not even a racial quota. The law apparently requires that 10% of funds "shall be expended through small business concerns owned and controlled by socially and economically disadvantaged individuals."

    So.... 70% of the US is either a woman or a minority but we have a thread complaining that 10% of the funds must end up in businesses controlled by those groups? What am I missing?

    I have somewhat of a philosophical problem with minority set asides for federal contracts including indirect federal contracts but it's time to get real. The policy has been around for decades. It's nothing new and although I haven't researched the issue I would wager that there have been several lawsuits challenging the practice. The one in the original post is by no means the first.

    The inherent problem with quotas is that companies are forced to hire some applicants that might not even be the best available worker and it also artificially makes those chosen peoples to be protected unlike anyone else. We cannot live in a country that protects one or two certain groups... that amounts to special treatment for some... which is not Constitutional - If we are all created equal then we should all be treated equal under the law.

    I don't know how much these quotas will affect the jobs at our company, but we have worked so far paying attention only to the professional qualities of employees.

    I can see both sides of the argument. But does your position extend to something like Title IX which seeks to ensure gender equality with respect to school sports?

    I know very wealthy Cuban and Puerto Rican owned firms that qualify for this. Our 70 person firm doesn't because we, well, are white. On top of that, there are many firms that have female "ownership" where the female is a token owner that will also qualify. These set asides are just wrong. It happened under Obama too. We had construction firms that had to hire minority owned firms just to show up. They didn't even do much work, just showed up, and half the time the people supposed to be on the payroll for those DEB's didn't even show up. The GC actually preferred that the DBE subs didn't do any work because most of what they did had to be redone to pass inspections. Then if they didn't get paid for nto showing up, the minority % of payroll for that month would fall below the required threshold which would open up a whole slew of paperwork that had to be documented to show why payroll for that period fell below the required set asides. These are as bad as unions when it comes to make work wasting money driving the cost of everything up.

    I see what you mean here, but it's not really the same thing. Dictating mandates to private companies with regard to hiring should not the purview of outside sources or quotas. This can actually be dangerous if you demand less qualified people to work in nuclear power-plants based on gender or race and not qualifications... best qualified.

    Student athletes are not employees, and most of them play on teams that are public universities.

    I have subcontractor clients that confirm everything you said here.
    Shame - because people now assume the minority contractor is just a placeholder and is inept at doing work

    My buddy and his wife started a commercial landscape business. It was rough at first until they put her as 51% owner. Then she joined NAWIC and became active in the organization.

    After the changes they were considered minority business owners. Instantly their bids started being accepted and they had to turn down business.

    They played the game and won.
