I’ll add to that for you. If he’s charged with a 2F for transmission or possession, it’s really bad. (With the number of images we know of, that involved visual images of abuse and/or children of an extremely young age)

 

Because none of us know what he did, age of consent laws are what they are. No one on this thread knows exactly what he did. He may have done horrible, perverted shit. But no one knows that right now. He may be a sick pedo, or may have been doing internet shit with a teenager. I don't know, and neither do you.

I prefer to wait until the facts come out. Plenty of innocent people have gone to prison in this country.

 

He’s right though. It’s not age of consent laws that are pertinent. It is how the possession and transmission offenses are defined in the relevant state, which here is Florida.

 

Have you read post #52? It gives the cop’s version of what happened. He transmitted 2 images of child sex abuse on discord… then they found 3 more images on his computer. Seems like he’s admitted to doing it, as well, but said he did not think they were illegal images…

 

I also took exception to the original post, to which, IMO, you responded appropriately. It did clearly imply that the administration and BN might not appreciate the enormity of the situation and would suffer grievous consequences if things were not "handled" appropriately. It struck me amiss in the moment that there was any doubt that UF or BN would fall short of the mark in this very trying situation. I have great confidence in the integrity of the administration and in BN personally, and I felt that the original post brought that integrity into question - at least to some extent. Hence my characterization of the post as being idiotic. I will have nothing more to say on this particular aspect of this sorry episode.

Wrong. If they are of legal age of consent, where is the crime? Unless there is some internet stalking or harassing or some such.

No state has a legal age of consent over 18, to my knowledge. In some, the legal age of consent is 16.

I think you're conflating sexual contact with the distribution of illegal images. I really don't think age of consent factors in here at all.

 

I appreciate your perspective and that your situation was morally acceptable if technically illegal.
There is one factor here that likely makes this much different and that’s the involvement of the National Center for Missing & Exploited Children (NCMEC). Their database is almost exclusively dedicated to tagging pornography of obviously young (<12) children. They tend not to bother with older teens due to the difficulty of proving age <18. Innocent until proven guilty as always but The referral to gpd coming from here is EXTREMELY concerning.

 

Man I read through all these pages hoping that one of y'all had a friend in GPD or something that told you whether it was actual child or 16-17 year old stuff. I was hoping one of y'all had some inside info. From the reports, it looks like its actual child porn and not like it could be borderline legal/illegal. Sick stuff man. You're a known QB at UF with all these girls around and you feel the need to look at stuff like that?

 

He is of course "innocent until proved guilty." But it doesn't look good, and the administration must act decisively once they have the charging docs in hand if the information in those docs is as damning as it has been reported to be. Justice must be served, one way or the other.

A 17 year old situation that looks over age wouldn’t have raised a red flag. That type of material is everywhere.

At this stage it’s clearly not a case of “I got it off a well known site and I thought she was over 18”

Heck if she (assuming it’s a girl) was REMOTELY close to being near 18 his excuse would have been “she’s over 18 what’s the big deal” rather than “oh was that wrong?”

The University has to go through its formal disciplinary process to expel him. I expect he’ll withdraw from school before that happens (like Cam did).

Has nothing to do with how “bad” the images are. Simple possession of CP is a 3F, possession with intent to promote is a 2F. From the statute: “The possession of three or more copies … is prima facie evidence of an intent to promote.” That’s why he got 5 second-degree counts even though only two were shared on Discord.
