Trump administration refers NY AG Letitia James for possible prosecution over allegations of mortgag

    No idea if LJ is eligible for a VA loan….she a veteran ? Rough numbers conventional loans are 75% with VA/FHA/uSDA the other 25%. This will be easy to see. Just release the first page that she signed at closing. That’s where it says the type and terms of the loan. I’ll reserve judgement till I see that

    but either way way, a loan on a primary residence will have a lower interest rate

    I’m typically cautious on stories like these, as you seem to be as well. However, primary res on a vacation home or investment property is not an error seen often on initial loan applications. Further compounding matters is the fact it was James’ POA who filled out the forms for her. Fat chance a hired legal hand would screw that up. Lastly, for the reason you mentioned, it’s unlikely she would have been referred if this was corrected prior to the final loan application signed at the close. Agencies are typically meticulous in how they pursue these things and would realize mistakes do happen, though highly doubtful considering the POA involved.

    I can’t see the post you’re replying to, but as for the appraiser, how would they have known for certain about the intended use of the property? I presume this was your typical everyday residential home.

    I'm sorry, but I have difficulty believing an ostensibly educated person who's purchased real estate before, mistakenly identifies residential property as their primary residence when making application for a mortgage or completing any other document. You know where your primary residence is located, especially if you hold elected office that requires you to reside in a specific city, county, or state.

    Additionally, it appears this is a matter that's existed for 8 years and has not changed? Does Virginia tax a primary residence differently than an investment property eg homestead exemption? If it does, seems someone would have realized this mistake sometime of the past 8 years and taken the appropriate corrective actions.

    Banks and lenders have been hyper-focused on occupancy fraud for a long time now. This would not have been as simple as James applying for the Virginia home as a primary residence on her application and that was the end of it (oops). Banks and lenders have checks built into their underwriting process. This means the perpetrator must typically go to great lengths to get around those checks in order to prove the home will be their primary. For example, your paystubs say you work in NYC. Are you a remote employee? If the story is true, it will be more than she applied for the loan as a primary residence. There are going to be other things she fudged during the process that will show fraud.

    Boilerplate language typed up by some low level assistant that assumed they were husband and wife and didn't edit the last part of the form. They file a corrective deed, assuming that is appears on their deed the same way, problem solved, costs about $5....

    How much of your tax money do you think Trump has spent to find a banking assistant made a mistake 42 years ago?

    Edit ... She also sold the property 25 years ago ... yeah, bro, she's going down ... LOL.

    Oh look... I found the actual deed from 1983, and guess what it, it says "his daughter" on the actual deed.

    Classic case of projection. This has to be the new gold standard. I've been arguing here forever that the ones not 'pulling over' for Trump are insane and thus likely projecting a sordid past. Don't be surprised when Jack Smith is brought down for something similar.

    Was going to post something similar. Rather than an intentional attempt at fraud the designation of Letitia James as the wife of Robert James on the mortgage rather than his daughter was most likely a drafting error. I would also add that when the property was purchased in 1983 Letitia James was 26 years old and had received her undergraduate degree two years earlier. When my son purchased his condo the lender required that my wife and I be listed as co-borrowers and co-purchasers because he was 24 years old, less than two years out of college had a very sparse credit history even with a FICO score close to 800. The chances are that James' father was on the deed for a similar reason.

    If anyone should be prosecuted for treason it seems that the guy sitting next to Putin is the much more likely candidate. Maybe he's concerned about "Russia-Gate" because he was complicit.
