    the illegal alien is a member of MS13 and is in jail in El Salvador- he is a citizen of El Salvador- Trump cannot force them to send him back

    A. He has never been convicted of a crime. The entire evidence that he is a member of the gang is one, uncorroborated informant. If the government has more evidence, it is hard to imagine that they would fail to provide it at this point. It is also difficult to imagine that an actual ms-13 member wouldn't have any of the tattoos associated with that gang (unlike the Venezuelan gang, there actually are distinctive tattoos for MS members). Finally, it is difficult to imagine that he was a member of MS for years without even an arrest for some crime. MS actually commits crimes. The fact that he was never arrested for a crime suggests that he isn't MD without substantial evidence that he is.

    B. You have no idea what they can force the El Salvadorans to do. That is because the agreement that we signed with them to ship them prisoners for money is "classified" for some reason. However, it is hard to imagine that the El Salvadorans would even consider endangering the agreement to pay them to be the work-around for due process in this country over 1 prisoner. They just are making sure not to endanger that by helping the Trump folks ignore the courts, which benefits both of them (the end goal here is to start shipping US citizens there as a way to bypass the judicial system).

    He was here legally. And without due process, he was arrested and shipped to El Salvador. No habeas corpus. If the government can do this to an immigrant here legally, what's to stop them from doing this to citizens?

    And for the record, this man has no criminal history. None in Venezuela and none here. His only connection to MS-13 or any gang is a single accusation with no corroborating evidence. If he is too die in an El Salvador gulag, at least he deserves his day in court. Like the Constitution demands, backed by the Supreme Court.

    I certainly have opinions on the legal aspects of the controversy and have a pretty good idea of the probable outcome. Unfortunately, the legal debate has become so politicized that it is difficult to have an intellectual legal debate.

    It reminds of two decisions I made on a couple of cases that had become highly political. With one decision I was called a far left liberal commie and the other i was called an extreme right wing nazi. However my rulings were consistent in both cases. I learned that when issues become highly political many people's view of the legal aspects of a case reflect only their political view.

    So as interesting as it might be to have this legal discussion, I will defer to others

    Maybe he is a member of MS13. Maybe he's murdered people. Maybe he's just a terrible person all around. Guess what? Our constitution says he still gets due process.

    Instead, you're cheering on the stripping of constitutional rights. Take a very long look in the mirror.

    They could easily “facilitate” his return if they wanted. Simply tell Bukele: “Return him or we stop all payments.” Easy peasy.

    If I were thinking about crossing the border and knew about this guy and others being shipped off to El Salvador I’d probably not do it.

    Curious how many people this will stop coming here to seek citizenship or hide out like many others have?

    Poster almost just got another perfect score..... you got one fact correct. He is NOT an illegal alien in US. He is not proven to be MS13 at all. He is not a Salvadorian, and the skidmark can force El Salvador to return him. He only needs to ask. Too bad you guessed right on the jail location.

    2019 immigration hearing. An anonymous person claimed he was an MS-13 leader. That's it. No corroborating evidence, and again, zero criminal records both in Venezuela and a decade living in the US.

    A judge did rule his life was in danger from MS-13, which was why he was granted protected, legal status.
