Doubtful that her family wins. She was a member of a violent mob that tried to access a restricted area within an already restricted area that she unlawfully entered. That is a pretty obvious situation in which deadly force is warranted. Again, if you shot somebody entering your workplace through a window that was smashed by a violent mob, you would be justified. That is why you avoided answering that question when it was posed to you.

 

No you want a hypothetical answer. We do not know. And she was killed so we do not know why she was climbing through the window. You don't know. And I don't know.

Again, we both know that if a violent mob smashed through the window of your closed business and somebody climbed in, you would view that person as a threat to you and anybody else in that building. And that sets aside the fact that she had already broken the law by entering a restricted area before she got to the window. So really, the closest comparison would be a mob breaks through a locked office where your employees are hiding and somebody from the mob enters. I'm sure you would offer them a bottled water at that point though.

Not only was the shooting of Ashli Babbitt absolutely justified, but in Florida the co-insurrectionists at the door with her would have been charged with her death under our felony murder rule statutes.

 

As a resident libertarian on this board, A Babbit death was tragic but she’s gotta own that. Yes the officer that discharged his weapon had a horrible track record but what did she expect to happen with a LEO pointing it at her from 6 feet away. Sadly she got carried away and paid the price

Anytime an officer discharges his weapon, it should be to kill.

 

She was in the Capitol because she was an angry and mentally disturbed individual who believed the lies told to her by Trump about the election, like much of that crowd (based on her social media history prior to the event). In terms of why she went in the window, I will go with the obvious motive: she wanted to access the next restricted area, which contained members of congress and their staffs. I do not know what she was planning to do to them afterwards, but it is not unreasonable to presume that she, as a member of a violent mob who just smashed their way through the windows and tried to smash their way through the door, was intending to commit violence or allow others to commit violence.

 

That is the intent of a gun, so, yes. She was trying to access an area with members of Congress and their staff (and likely members of their families). That officer was tasked with protecting those folks from a violent mob that would likely harm them (given what they had already done). At that moment, what other option did you have, hope they didn't harm them?

 

What's to stop the incoming administration from killing the outgoing president and pardoning the killer? I guess nothing.

It’s crazy the inconsistency people have with these things. Same people are ok with no knock warrants and people getting shot in their own beds. But this one is on the officer? Disgusting freaks.

Did the officer 100% have to resort to lethal shot? Perhaps not. No other officer fired a shot at all, despite a few that pulled their weapons in defense. But that “was it 100% necessary” ain’t the legal standard or there would never be a police killing in this country. I don’t see how anyone can watch the video and see anyone but Babbitt in the wrong.
