They'd have to start from scratch. Judge ruled Jack Smith illegally appointed. Jack appealed ruling. Jack withdrew his appeal, before it was ruled on. Judgment stands, rendering all of Jax axns, nullity.
Not surprising since he was appointed specifically as Special Counsel to handle the investigation of Trump's apparent violations of the law and in any event he probably would have been canned within 24 hours after 12 noon on January 20th.
From what I could determine that 11th Circuit has yet to issue a decision on whether or not Jack Smith was illegally appointed. Smith dropped the case against Trump it's still pending against his co-defendants and if he drops the case against them their attorneys would be able to use the argument the release of the Report would prejudice the cases against them. I would also add that the Mueller Report was released even though Mueller indicated that Trump could not be prosecuted because he was the sitting president at the time. Ironically, a very strong argument can be made that Cannon no longer has jurisdiction over whatever Smith does given that she completely dismissed the case. Release of the report would not constitute prosecution of Trump.
I believe unless Cannon is overruled by the 11th Circuit, Smith is not a Special Counsel on the Documents Case. So he could not submit a report on that case, but could submit one on the the Jan 6th case. If AG Garland wants to appoint another member of the DoJ that has been Senate confirmed to their current position to Special Counsel, the Smith Report on the Documents case could still be turned in before Jan 20th.
