BREAKING: Trump LOSES Immunity Claim in NY State "Hush Money" Case

    Finally some good news. Trump lost his motion to get the NY State hush money case verdict tossed on immunity grounds. He remains a 34 time convicted felon, Lady Justice retains some of her dignity.

    He lost on 3 major grounds.
    1. His crackerjack legal team neglected to properly preserve the majority of their claims for appeal.

    2. Trump's actions were clearly unofficial acts.

    3. Any errors were rendered harmless due to the overwhelming evidence of guilt.

    Sentencing next and then appeals will follow.

    "Justice Juan Merchan found that a July Supreme Court ruling granting Trump presidential immunity for official acts did not preclude a jury from finding him guilty after a criminal trial this spring.

    Merchan wrote that evidence shown at trial pertained "entirely to unofficial conduct," beyond the scope of the Supreme Court's ruling, which he described as narrow.

    "If error occurred regarding the introduction of the challenged evidence, such error was harmless in light of the overwhelming evidence of guilt," Merchan wrote.

    No. He won't file his appeal until after he is sentenced.

    Quite possibly, assuming it gets there. It should go through the state appellate system first.

    he never hoped to win on the law, it makes the incompetence tolerable, and very profitable, provided you don't cross that line, which, in the end, djt always gets them to cross, sans Barr.

    this is what got me, and what should resonate from that verdict, but will be lost in the weaponization cries

    The ruling was issued today and is actually pretty big news. Some people actually follow important events.

    I’ve followed this as well and nobody in my orbit thought Merchan was going to rule any other way and not suprised by this ruling.

    Was he actually the President when the payments happened? If not, then how can you get presidential immunity?

    He will probably just end up pardoning himself.

    If living rent free means “I don’t think a man convicted of crimes related to election interferences should be President, since it demonstrates a total lack of respect for the sanctity of his office,” then yeah. Sure.

    I think it’s more damning so many of you are okay with deifying a felon who routinely doesn’t think the law applies to him.

    I believe that since this deals with his officials duties as POTUS, he is allowed to keep appealing and it can go to federal court up to the SCOTUS. I heard/read that since Trump does have immunity from official acts as POTUS, he is suppose to have the issue of whether something is an official act settled before the trial commenced. So Trump still has the right to appeal this decision to "the New York Appellate Division; even if he loses there, he will then appeal to the state’s highest tribunal, the Court of Appeals, and then perhaps to the U.S. Supreme Court." according to NR's Andy McCarthy.

    I think that this might end up being mute as Hochel may step in and pardon him in an effort by Democrats to enter a ceasefire on lawfare with Republicans now that Trump is about to assume office.

    Jerk Merchan gave the middle finger salute to the SCOTUS. It's a loser case and is as good as dead. You folks don't get it that Trump won with this decision. The case is DOA when appealed.

    Jerk and daughter are setting themselves up for some overdue payback.
