    If you simply applied black letter NY law, the level of force utilized in this situation was not justified. Based on the circumstances, however, the case had very little jury appeal. The jury exercised their "pardon" power.

    I don't want to talk about your son, but is he a violent drug addicted fellon that has hurt other people on the subway? If not, it's a lousy comparison.

    For what Neely said and how he acted. He was making threats, not all can be 100% verified. One lady said she was actually afraid for his life.

    My issue for those upset about what happened to Neely, is where were you when he needed help? He's running amok on the subway in soiled clothes making threats, being violent and his supporters are no nowhere to be found. So it's OK to let him terrorize the public, but the public can't protect themselves against him... Nope!

    So we are back to believing juries from New York rather than dismissing their judgment?

    Thanks so much for the clear explanation.

    While watching tv and the talking heads I heard that he could be retried on count 1 and that he could not. What do they know? You should be a consultant for them.

    Oh, so juries are only right when they do what you want? Does that make you the judge and jury?

    Are you trying to pawn off your own hypocrisy and perceived victimhood on me? I accept this verdict as I accepted the Trump verdict. Penny is not a murderer/a person who committed a homicide according to our justice system. Donald Trump is a felon. I accept both jury verdicts. That isn't hypocrisy. That is consistency.

    On the other hand, you accept this verdict because it makes you feel better and don't accept the Trump verdict because it makes you feel worse. In not accepting the Trump verdict, you create a victimhood narrative. That makes you hypocritical and grants you a victim status as a person who feels forced to feel bad about themselves by a New York jury.

    Enjoy your hypocrisy!

    You're welcome. Again, this was a very unusual situation.

    I used to be the attorney one of the hosts from a local sports radio station called to talk to on air when criminal/sports issues arose. It was fun and generated some business for me.

    It’s sad you think any homeless person who appears scary should immediately be killed by anyone who can kill him or her.

    Um I am sorry for you if you think a guy like Jordan Neely who had a record of 42 arrests including 3 unprovoked assaults on women (on subways) and was making threats should be left alone.

    By the way, just so you will know and I have mentioned this on this forum before but the only night I ever spent in jail in my life was a similar case to Penny's. I was driving past the Drift Inn Bar on Bradenton beach and heard a girl screaming. I jumped out of the car and told my wife to go get the police. Some thug was slapping the hell out of a girl in the parking lot. Being an ex high school wrestler it was nothing for me to throw a wrestling hold on the guy and pin him to the ground while waiting on the cops. When they got there they arrested him for being drunk and disorderly and me for disorderly conduct. I was found innocent and even got an apology from the judge but if the guy had died I could have been in the same boat as Penny.

    What really pissed me off at the time was the other guy's bail for drunk and disorderly was $52. My bail was $102 for disorderly conduct....Go figure. Those were 1972 prices BTW.
