Trump Vows To End Birthright Citizenship

    It's about time. Birthright Citizenship is one of the biggest mistakes this Country has ever made. This post makes it sound like it's mainly for anchor babies, but honestly Birthright Citizenship should be illegal in general.

    It's really not that hard. Regardless of where you are born, you are a citizen of the country of your mother. Your mother is an American, you are an American. You mother is Mexican, you are Mexican, your mother is Japanese, you are Japanese, etc. etc.

    This might up being the greatest 4 years in American history if the Republicans truly unite behind President Trump.

    “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. “

    it’s hard to imagine even this Supreme Court upholding that E.O. Since the obvious and “originalist” intent of the amendment was to give citizenship to foreign born slaves and their American born children.

    Besides, the next democratic president would just undo the E.O….. so we’d get several years of court ordered stays being issued, maybe in 3 years SCOTUS finds some mental gymnastics reason to side with Trump, then president Shapiro trashes the EO in 2028…

    The Constitution can be changed, and illegal immigrants are violating the spirit of the constitution.

    As many here have even admitted, the 14th Amendment was meant for former slaves and their children. By definition, they were allowed citizenship because they were brought here against their will. They had no choice. I have no problem granting an exception for descendants of slaves.

    Current day illegal immigrants though were never brought here against their will. So as far as I'm concerned the 14th Amendment doesn't apply and birthright citizenship is invalid.

    I understand it would be a mess to apply retroactively. My guess is President Trump applies it going forward. So any child of an illegal immigrant after President Trump takes office would not be granted birthright citizenship and I think it would stand up to the SCOTUS. And no Justice Clarence Thomas in this case would not be deported as he would be grandfathered in, along with all kids born to illegal immigrants before President Trump retakes office.

    Baby's don't have a "will" about where they are born, so your argument is invalid ... and the language of the constitution is unambiguous. "born" only has one meaning.

    An XO cannot overturn the Constitution, nor Supreme Court precedent. In this case, Wong Kim Ark, which helped established birthright citizenship in 1898. It will take a Constitutional Amendment to end birthright citizenship.

    Okay so if I had been born in France instead of the U.S. would I be a French citizen? The answer is NO, because the French get it right and do not offer birthright citizenship. And yes this almost happened to me as my dad was temporarily working in France at the time. I came within 2 months of potentially being born in France. Even if I had been born there, I would never call myself French. My mom is in American and therefore I am an American.

    Why is it so hard to just say a child is a citizen of the country of their mother? Do you not realize how stupid it sounds that a child, who has no agency of their own, can have a different citizenship than their mother minutes after being born? Like you said, babies don't have a "will" at that point in their life. They are a citizen of the country of their mother.

    I think this can be overturned without even changing the 14th Amendment. Like many laws, they are being abused from their original intent.

    The goal here is simple, get this in court and get it fast tracked to the SCOTUS. Let them finally, once and for all, interpret the meaning of the 14th Amendment. I think the 14th Amendment is only for slaves and their children/descendants and would be found not to apply for children of illegal immigrants.

    The 14th Amendment only applies to slaves and their children, people brought to the U.S. against their will. Illegal immigrants weren't brought here against their will and therefore the 14th Amendment doesn't apply. And I think the law will find that to be accurate.

    How does it feel AzCatFan? I see you are back. How does it feel knowing your "Gang of 8" idea will never see the light of day. Are you packing your bags yet? Many of your Hispanics are going to be going home very soon!

    I think Central American and South American countries should put on big "Welcome Home" parties for their returning citizens. :)

    Wong Kim Ark was Chinese. He was never a slave. The SCOTUS ruled in 1898 he was a citizen of the US, and birthright citizenship became law based on the 14th Amendment and the SCOTUS precedent. There are many other countries with birthright citizenship, including Canada, Australia, and Great Britain. We're not alone.

    And it sucks the Gang of 8 plan will never see the light of day. It's the only logical solution. And Trump's great deportation plan? You think inflation was bad after COVID caused massive labor shortages. How bad do you think it will get when half of our agriculture workers and a good portion of our construction and foodservice workers get deported? Be careful what you wish for!
