Thread got a bit off track, someone was saying how easy it to “sober up” while high as opposed to ETOH and that you have more control.
I voted no because there isn't a constitutional ban on marijuana, so it oughtnt require an amendment to the constitution (like it's some fundamental right) to legalize it. It doesn’t belong in the constitution. Doobage aside. That is, actual, direct considerations vis a vis the use of MJ notwithstanding (aside).
Either way, you going to have a tough time - at the very least - getting someone on a field sobriety test or DUI at all without some kind of blood test, which seems to be almost impossible now. Which is awesome. I love that this bothers you and will perpetually bother you. Whether it passes next week or not, it's inevitable. LOL at you!
I didn't lay it out that way, but that is the premise behind it. Those tests are for alcohol, and specifically test motor skills, which alcohol heavily diminishes.
Maybe, technically, I'm still "impaired". But there is NO WAY you or someone who doesn't know me well could tell if I was or I wasn't. Again with the After School Special version of "getting high". "Woah man, I'm tripping out. . . ." Yeah, it's isn't like that. But go have another drink.
The exercises are divided attention exercises...a motor skills component coupled with an intellectual component. The walk and turn exercise requires you to actually walk heel to toe on a line, turn and return. That's the motor skills component. You also have to remember to stay in the staging position until told to start, not start until told to do so, keep your arms at your side, count your steps out loud, walk the correct number of steps, turn with a series of small steps as instructed and return with arms at your sides, etc. That's the intellectual component. Failing to do those things as directed is just as much not properly performing the exercise as stepping off the line, etc. They are not strictly motor skills exercises, none of them.
Interesting. Good stuff! I would still argue there is a massive difference in terms of inebriation with pot vs. alcohol. So, in that respect, it's always going to be a bit problematic with respect to DUI's. Or, they're going to have to come up with a whole new series of tests, both field and blood.
If I was a stoner that drove impaired I’d carry a set of crutches with me. Tell the officer I sprained my left ankle and need them for assistance walking.
I always make the cops demo the field sobriety exercises for the jury at trial. One time during the one leg stand test, the trooper started visibly shaking and put his foot down before he counted to 30. Seeing my opening, I asked, "Sir, I'm not being flippant or disrespectful, but have you been drinking today?" He comes back with, "No, of course, not...I'm just nervous." I had him. "Trooper, you're nervous? You're in a well lit courtroom full of prosecutors and bailiffs with zero chance of going to jail no matter how you demoed these exercises. Can you imagine how my poor guy felt at 2:30 in the morning surrounded by armed law enforcement officers and police cruisers with emergency equipment activated knowing that if he slipped up on something he was going to central booking?" He just sat there with absolutely no idea what to say. I gave him a full minute and just announced "No further questions." I think it took my jury longer to elect a foreperson then to find my guy not guilty.
I'm not a child. There's a time and a place for that and it's not midday on a Wednesday. But go have another drink lush.
If there is no field sobriety test for it, then there are two ways for someone to get busted for it. Cop smells the pot and calls in the canine to get a positive reaction, or wait until they are in a crash and give them the blood test (assuming there is an injury or death). Not sure how long THC stays in your blood stream after smoking.

What a foolish reply. I pray some stoned driver doesn’t wreck and wipe out any of your family. Also I pray that nobody you know has a family member affected by Cannibis Induced Psychosis. The funny thing is despite numerous scientific studies proving that it’s an issue you dismiss the idea because it’s your drug of choice. Almost the definition of cannibis use disorder. You “feel” like you’re a pro buzzed driver on weed despite objective measures showing you wouldn’t be. The only thing that bothers me is how people choose to ignore the facts because they never had a problem and think it’s some benign plant. Good luck
If you are a habitual smoker of HPTHC it can still be positive in a sensitive urine test for 90+ days.
You must be proud that you can get away with driving impaired and knowing you can beat the system. Hopefully you never hurt someone when driving stoned. and impaired.
