    In a move that critics are calling a flagrant abuse of power, Florida’s Department of Health is threatening to bring criminal charges against local TV stations airing a campaign ad to overturn the state’s six-week abortion ban signed by Gov. Ron DeSantis.

    The unusual warning from the Republican-controlled state agency prompted the Democratic chair of the Federal Communications Commission to step in on Tuesday.

    Jessica Rosenworcel, the FCC chair, said that stations should not be intimidated for airing political ads.

    “The right of broadcasters to speak freely is rooted in the First Amendment,” Rosenworcel said in a statement. “Threats against broadcast stations for airing content that conflicts with the government’s views are dangerous and undermine the fundamental principle of free speech.”

    In cases like the woman depicted in the ad, these gray area cases have doctors cautiously sided on “staying out of prison” over “doing what’s best for the patient”. Thats a fact, and we’ve seen it several times. There is no reason why women should have to leave the state for potentially life saving treatment. but regardless, she and the TV stations have a right to broadcast her opinion even if DeSantis doesn’t like it.

    This is a misrepresentation of the "threat" - if you look at the cease and desist letter, it cites the ad containing false information.



    There's an explanation given on why the claim in the ad is false. Not saying I agree with the cease and desist letter or not, but it's worth pointing out that the concept in the ad is fundamentally inaccurate as it pertains to FLORIDA's law. I say this as somebody who supports Amendment 4. No reason for the deception. Whether or not the government should go after an ad for containing false information is another can of worms altogether.

    Total bullshit. That letter, at the start of page 2 is absolutely threatening legal action. You are better than spreading false information.

    Also, the ad is not false. The Florida law says things like a serious permanent threat to a woman’s health must exist. Who decides how to interpret that? If a doctors says “You have serious condition but 99% of women with your condition deliver health babies”… well, that sounds ok. If a doctor says “you have 30x greater risk than most women of your uterus rupturing and if that happens, both you the baby will die in great pain before anyone can get you to a hospital” … that sounds awful, probably should get an abortion. But guess what, statically, I’m saying the same thing. So who decides? It should be the woman, 100% of the time.

    Thanks for the clarification, but if we're to prosecute all political ads that contain mis-leading or innacurate information, we're gonna need a lot more lawyers and judges.

    I agree. My position on this is similar to the one on abortion. We should want fewer false ads, but we don't want the government to regulate them.

    Two doctors, per state law.

    There are a variety of interpretations on risk from doctors; my wife's doctor flat told her not to get pregnant any more because it's too risky. It would not be hard to find a doctor that would identify a legitimate risk as "reasonable," when you consider that their primary focus is on the mother.

    Agree on that part.

    In short, if you never want to see any of these ads again, vote Yes on Amendment 4.

    Voting Yes slams the door on the Pro-Life movement forever in FL. In the end, overturning Roe will be the death of the Pro-Life movement as a national political issue. Make it happen!

    But you know the problem is that doctors are scared to sign off on abortions in gray area cases (we’ve seen it already), and that woman in the video has no right to an abortion UNLESS two doctors sign off. It wouldn’t be her choice. She is banned by the law from having a choice on her own health. The woman in the video has a brain tumor. I don’t know why, but her doctor recommended an abortion even though the connection between a brain tumor and risk of death from pregnancy isn’t clear to me as a lay person and potential juror. Thats why doctors fear arrest in these situations. If they get arrested, they may to convince a jury that being pregnant poises a greater risk of death to her than just having a brain tumor. And state will call in their witnesses to dispute that….

    generally, when maga runs around professing to strictly adhere to the constitution or to be a “constitutionalist” they ultimately have no interest in following all of it.

    It's sad that you'd try to defend this. They're threatening criminal action against a TV station for broadcasting an ad featuring a woman speaking truthfully about Florida's abortion restrictions. The segregationists in Alabama tried this exact same behavior with Northern journalists who wrote unflattering things about them during the Civil Rights Movement. The Supreme Court eventually smacked them down for it. Because it is as clear a violation of the First Amendment as there is.

    Even if there was "deception," it's protected speech. But let's be clear, there is no deception here. Just a woman speaking honestly about the harm being done by the laws passed by DeSantis and his cronies. It's pathetic behavior from the freedom-hating losers in Tallahassee.

    The problem is especially acute for cancer patients, like Caroline, who must undergo an abortion in order to receive chemotherapy. Florida’s exception does not clarify when a patient’s cancer is severe enough to justify termination. These women may have to wait until their tumor grows before a doctor will certify that it will cause “substantial and irreversible physical impairment.” In fact, Physicians for Human Rights interviewed a Florida doctor whose patient needed an abortion so she could undergo chemotherapy for metastatic pancreatic cancer. The doctor worked with lawyers to compile the immense amount of paperwork necessary to prove that her patient qualified for an exception. It took so long that she ultimately urged the patient to drive four hours to terminate elsewhere. This denial of medical care is precisely what “Caroline” warns against.

    Yep they bark about small government when they actually pursue the opposite, they bark about freedom as they take rights away from people, they bark about free speech as they push the opposite. See a theme here?
