Judge delays sentencing in Trump's New York criminal case, pushing decision past election

    Justice Juan Merchan issued an order on Friday delaying sentencing until Nov. 26.

    Merchan wrote that he made the decision "to avoid any appearance — however unwarranted — that the proceeding has been affected by or seeks to affect the approaching Presidential election in which the Defendant is a candidate."

    "The Court is a fair, impartial, and apolitical institution," he continued, adding that the postponement "should dispel any suggestion that the Court will have issued any decision or imposed sentence either to give an advantage to, or to create a disadvantage for, any political party and or any candidate for any office."

    Is he talking about his court? Does he really think anybody with half a brain is going to believe that?

    If he was horribly conflicted and just out to get Trump then wouldn't he have kept sentencing as is and sentenced him to jail prior to the election? Sure, Trump wouldn't serve any time before the election but it could have hurt Trump with voters.

    I am guessing he will rely on the Supreme Court immunity decision when he drops it on November 28th. My read on this is the judge is trying to hurt Trump more by dangling the possibility of a harsh sentence over voters instead of being forced to rule now that he was covered by immunity.

    He’s getting jail time. Judge doesn’t want Trumps time in the cooler to be considered a politically motivating event.

    No, he probably thinks people with full brains will think that. People with half brains believe whatever Donald Trump tells them to make both himself and them feel better about his being convicted of many felonies.

    What in particular is it that you don't believe? That Donald Trump would cheat on his wife? That he would do so with a person who has appeared naked? That he would engage in illegal accounting practices to try to cover it up?

    The entire story. We all know Stormy Daniels lies she's admitted it, her lawyers have admitted it. Why should we believe anything about this case if we can't believe the details? Then there is Michael Avenatti, no need to go any further.

    So why do you think Donald Trump chose to falsify business records to pay her then? We have the false business records and his own employees saying that he did that.

    Let’s just assume it was false, what exactly was unfair? Trump was represented by a high-power defense team and a jury of his peers, including a Trump voter, collectively decided he was guilty. So I ask again, what was unfair that the court did?

    I vomited all over my keyboard reading Merchan's ruling. This politically motivated judge has been biased and unfair in using lawfare against President Trump.

    Senator Elise Stefanik of New York filed ethics charges against Merchan on Friday morning. By noon, Merchan released this falsely described decision about fairness. Merchan doesn't give a damn about the law or fairness.

    Merchan must first rule on the presidential immunity evidence he allowed into the trial which he has not done before he can sentence Trump. The minute he rules, off it goes to higher courts where anything Merchan wants to do concerning sentencing Trump to jail goes out the window in an overturn.

    Trump is no more a felon than anyone here with a clean criminal record. This prosecution has been about lawfare with the intent to commit election interference against Trump, the undemocratic party opponent.

    This and other lawfare prosecutions far exceed anything ever done in this country. The undemocratic party has led the US completely through being a banana republic into an openly desired one-party system like what they have in China and Russia.

    The House is investigating Merchan and his daughter who is a democratic party supporter and donor. To say the least, this could get fugly for father and daughter if what they did involving family money donations and money received goes beyond ethics violations.

    If Trump looks like the winner, I wouldn't be surprised to see him reverse course, rule on presidential immunity, and dismiss the case himself. Why would he want the winning presidential candidate gunning for him with the case still unresolved?

    What Merchan has participated in against Trump is at minimum deplorable, unethical, and an abuse of power.
