Selling drugs? Possibly. The officers may have been suspicious because they were walking in what appears to be a warehouse district whereas a father and son out for a predawn stroll might be expected to stick to sidewalks in a residential neighborhood or take a walk to a nearby park. The thread's title is inaccurate as the father and son are not black.
Bad attitudes all around. I understand why the cop thought it was suspicious. The guy certainly got defensive immediately. Could have avoided putting his kid through that by being a bit more civil. The cop is a POS though. Zero reason to slam him the ground in front of his kid. And he apparently has a long history of complaints. I hope he gets canned.
Agreed. There is no reasonable suspicion of anything. Because there's drugs and spray painting going on somewhere in the neighborhood, by this cops logic, they could stop and ID anyone in the area because they might be spray painting something or selling/buying drugs. This is obviously a neighborhood you can't walk through without surrendering your rights. A Constitution-Free zone. It's not like the dad had a visible spray paint can in his back pocket, or the kid was smoking a J. And like you mentioned, there was 2 other cops on scene that did absolutely nothing.
I agree, the cop was out of line. My previous post offered a reason why the cop's suspicions might have been raised. A warehouse district is an unusual place to take a walk at any hour of the day or night. My post offered a possible explanation to WDG's question in post #35 as to what was going through the cop's mind. Not saying I agree with it.
Because WTF gets stopped while out walking in public with a child unless you are in redneck sh!thole state where police have delusions of God-dom?? Who cares what the race of the person being stopped is?
Original title of thread New red state crime "Walking while being black" Sorry buddy this thread was off the tracks from the title and first post on. You just keep derailing it when you suggest "Most of us would not be stopped and questioned" then you suggest this thread is about redneck shithole red states. The original title and subject of this thread was Walking while being black. I corrected the original poster in post #16 at 11PM last night it the screw up wasn't addressed until around 8AM this morning. You still want it to seem like person stopped was somehow different than "most of us".
Selling drugs? To whom? I didn't see the father approach anyone or any passing car, there were NO attempts to interact with anyone. Possible drug activity will not fly. Graffiti won't work either as that requires spray paint cans which neither the father or boy had. Potential burglars? Were they on any businesses' private property? Trying door handles or checking to see if windows were locked? Try to hide from the police? There is no viable argument to make that these cops had reasonable suspicion of any criminal activity. Fire them and have the city stroke a check.
Doesn't change the nature of your comment one IOTA. Embrace who your are....Trump might be president again, no need to hide it.
Unusual =/= suspicious. Reasonable suspicion requires suspicion of an actual crime either having been committed, being committed, or about to be committed with specific and articulable facts. Absent some other factor, merely being in an unusual location and/or at an unusual time does not alone point to criminal activity. Without reasonable articulable suspicion of some crime, the detainment was unlawful, and the father was within his rights to refuse to show ID in Oklahoma assuming the alley was public property.
