He's not just a citizen, he's a former President who has rights. I think most rational people know the DOJ should have never sent the FBI there, Biden made this a political attack

The timeline of events has been posted several times. Trump was asked to return the docs several times. Not only did he not return them all, he lied about it. Trump was also warned, several times, that if all the docs were not returned, the Feds will be coming. Trump has nobody to blame but himself.

As for Cannon's ruling, it seems to be based on Thomas' dissent. Which means, if the case ever gets that far, Smith will likely win on appeal. But I doubt Cannon cares. He job was to delay and run interference for Trump. Mission accomplished. How anyone thinks this is just is beyond me.

Are there limits to the rights of a former president? How many government files is he allowed to take? For how long? Where can he store them? How many times is he allowed to refuse to return them? How many times is he allowed to lie about having them?

Nowhere in The Constitution or in any other law are their special enumerated rights for the class of citizen that is "former presidents."

The files are not a former presidents to take. They belong to the United States, not the office holder. He is like anyone else who takes someone else’s property even by mistake— when you willfully keep it, you are a thief. And he is like anyone else who keeps and intentionally hides classified information— he is in criminal violation of the Espoinage Act. But it doesn’t matter to the zealots who call it “law fare” or “political prosecution.” He has been treated like no other criminally accused would be in this country. Another example of the politically powerful being treated differently than anyone else. For whom he is a hero.

The bonafides of the special counsel law was addressed in the Nixon tapes case before the court addressed executive privilege. Cannon swept it aside as supposed “dicta” while latching onto a dissent by Justice Thomas on an issue that wasn’t eleven raised in the immunity case. Courts do not reach out to decide issues that are not in from to them. That is a fundamental principle of judicial restraint. Thomas’ concurrence was purely political and intended to bring about this result. As I have said before, Cannon has been banking on a path to the Supreme Court being Trump’s re-election. And Matt Gaetz that’s let everyone know she will be under consideration

Wait, if you don’t know what are the exact limits of the rights of a former president, how can you be so adamant that Trump didn’t overstep them?

It's funny how some Dems think that they can invent precedence by continuing to break the law by illegally creating a special counsel prosecutor. They think if they do it often enough that somehow it becomes law... codified.

Funny how Maga can't see that Cannon did not cite precedence as rational for her idiotic conclusions. Cannon will be overruled in the 11th and a actual competent judge assigned.

It's been recognized law in this country since Nixon. Thanks for playing.
