    Right decision based on what the NFA actually says. If Congress wants to pass a law banning them, no objection to doing so.

    Hell will freeze over before a bump stock ban gets through congress. It is clear where the priorities lie: your right to slaughter as many people as possible as quickly as possible takes precedence over all other considerations. High fives all around.

    Just here to laughingly question whether this is an example of Trump 4D chess.

    He directed DOJ to do something that it so clearly lacked the legal authority to do that even under Obama they kept saying “sorry, they aren’t machine guns and there’s nothing we can do about them,” but also appointed Supreme Court justices to strike down the illegal things he demanded DOJ do.

    This wasn't a 2A case, and is probably the correct technical decision under the NFA, but man is it hard to morally justify allowing someone the right to turn their rifle into a veritable machine gun just because it's not a continuous trigger pull.

    Although the result was actually foreseeable Trump's support of the regulatory ban on bump stocks was almost certainly based on the advice of lobbyists from the NRA. Based on his history it's extremely unlikely that Trump supported the regulatory approach solely on his own volition although in it's own way it was brilliant strategically by allowing him to claim that he supported the ban while knowing it wouldn't stand up to scrutiny by the strongly pro-gun SCOTUS majority.

    Incredibly stupid to try and ban a piece of a firearm, the part that doesn't actually kill anyone. The court did the right thing here, stupid precedent if it had passed.

    If you want to ban weapons, say so and run on that platform. Stop trying to be coy and dishonest. All this is doing is making Lawyers rich, they love this ambiguous BS.

    It also came on the heels of the Vegas massacre. Just a matter of time before the next big event, followed by the exact same debate that has been going on for years, followed by doing absolutely nothing ( except of course for offering those utterly useless thoughts and prayers). Rinse and repeat. Actions speak louder than words. Wrap your heads around the idea that these events are not going to stop and may actually accelerate. This is who we are.

    My best guess as to what happened is that the NRA got worried there may be enough momentum to actually pass substantive gun control legislation and that they might lose control over what was in it, so they said “you don’t need to pass anything, these are already illegal ATF just needs to recognize it,” and grossly misread how much their membership distrusts and hates the ATF.

    Trump isn’t a gun guy (or a regulatory policy guy), and probably didn’t really consider it in any detail beyond “the NRA are the gun people, so gun people must be okay with us doing this.”

    When ATF put the rule out, the 2A advocacy groups that are more focused on actual laws and precedents (rather than buying suits) went “oh shit, the NFA is pretty damn clear these aren’t machine guns, if ATF gets away with just going ‘close enough’ it’s going to set a terrible precedent on their ability to just unilaterally act.”

    Biden got in office, and ATF is now continuing on their precedent of just making stuff up, but has now had a very bad week of various courts striking down a bunch of that just made up stuff.

    Ok, let’s not get silly. No single part of a firearm kills people on its own. The weapon needs all pieces working to be effective, and even then it needs an operator to use it. If you take out the firing pin or any other component it’s not going to shoot.

    So yes, it makes perfect sense to ban a component which turns a legal firearm into something that is functionally equivalent to an illegal firearm. 2A proponents are the masters of semantics when it comes to arguing against restrictions. My favorite was how they said an AR-15 was not an assault rifle because it did not have the 3 round burst function of the military issued M4 that nobody even used.

    Yes, I know that the M4 is now fully automatic, but they were saying that before that happened.

    I have pretty much come to the conclusion that Christian Nationalists, the GOP and Conservatives in General
    seem to have a fanatical obsession with sperm entering the vagina. Apparantly these folks will fight to the death
    to allow that sperm to attach to an egg and create life, and of course ultimately a baby.

    I mean they move mountains over this. They turned back Roe.

    Where I become confused is what happens as soon as the infant leaves the womb.

    When one reviews conservatives voting records, they:

    1) Consistently oppose legislation for extended mother work time relief to raise the child.
    2) Daycare? - LOL
    3) Consistently check legislation for food stamps and housing for the less financially fortunate.
    4) Consistently check public school funding, for religous education.
    5) Consistently check any legislation for relief related to College tuition.
    6) Consistently turning back reforms to protect LGBTQ persons.
    6) When a kid turns 18? Forget about it, they are on their own.

    Just seems Oxymoronic to me. Protect the fetus, who cares thereafter??

    We are the Poster Board Society for domestic gun ownership, gun violence, gun deaths and injuries.

    It's just the way it is. A paranoid, racist, violence loving society. That kid returning an air soft gun getting shot
    in the back by some asshole that was looking to murder a black kid takes the cake.

    Nor do I hold conservatives soley responsable. The "Hollywood" types have done NOTHING to protect the minds of
    children and young adults. Hyper violent video games and basicly everything on TV and in the movies is some form of
    "idealized" and non-stop murder / violence. I wonder what the body count of all the John Wick movies are combined?
    1,000?

    And of course, apparantly conservatives are now on board with allowing gun toters to shoot whomever they want if they "feel" threatened.
    Especially persons of color, immigrants, gays, and of course liberals or registered Democrats.

    Agree, but you left out a few things; Christian Nationalists, the GOP and Conservatives in general also really love guns, and want everyone to have guns. They do NOT care about people having health care, and actually OPPOSE efforts to expand health care.

    The interesting reality, for some time now, is how morally bankrupt the majority of Christian Nationalists, the GOP and Conservatives in general are.....at least when it comes to who and what they vote for.

    The people who care about caring for their fellow man, in general, are the godless lefties who support baby killing.

    As an aside, other than some of Benitez' opinions, Thomas' opinion has to be the most technically correct and clear discussion of the function of a common firearm in a judicial opinion that I've ever seen.
