Did a law change? I would think that him simply putting his hands on Briggs should give them the ability to add assault to the disorderly conduct. Adding in that he then moved Briggs against his will should make a charge of assault hard to deny.
In Florida it would be a battery. Wisconsin doesn't have a formal charge for assault and, due to lack of apparent harm, it does not meet their statutory definition of battery. The conduct does meet their definition of disorderly conduct, it is a proper charge. As I indicated above, it is also a false imprisonment as defined by Wisconsin law. 947.01 Disorderly conduct. (1) Whoever, in a public or private place, engages in violent, abusive, indecent, profane, boisterous, unreasonably loud or otherwise disorderly conduct under circumstances in which the conduct tends to cause or provoke a disturbance is guilty of a Class B misdemeanor. (2) Unless other facts and circumstances that indicate a criminal or malicious intent on the part of the person apply, a person is not in violation of, and may not be charged with a violation of, this section for loading a firearm, or for carrying or going armed with a firearm or a knife, without regard to whether the firearm is loaded or the firearm or the knife is concealed or openly carried. Thank you. Is it common for states not to have assault as a chargeable crime? Seems like that and a requirement for harm to be the basis for battery would allow for a lot of bad behavior before rising to a crime.
My fault and I apologize. I was trying to make a snarky comment because I misinterpreted your comment as asking why Briggs wasn't charged with assault. For the record, I'm still waiting for some sort of confirmation that this was actually race related. Seems like an awful lot of jumping to conclusions for a situation we know very little about besides the video. There could be history with the superintendent we don't know about.
Thank you. I guess it’s legal up there to badger people all you want as long as there’s no harm! (I know that’s a bad joke, but couldn’t resist). I guess Red Foreman could have really put his foot up one of the boys asses and not get charged with battery as long as he didn’t injure them.
What doesn't make sense is if he's a racist, wouldn't he have already trained his daughter to be racist as she grew up and possibly even instructed her not to shake the guys hand when she got her diploma? Him jumping up there to do this is strange, even for a racist.
I read this AM She may have been suspended previously for bullying and cyber stalking or something, don’t know if it’s true. If it is though, he could just have a beef with the admin. Or it could be both, he could have a legit beef and took it out on the one black guy there.
